HUEY P. NEWTON, co-founder of the Black Panther Party,
' has been ordered to trial a third time in the 1967 slaying of a
rookie policeman.
Newton's second trial for the offense ended Sunday when,
after six days of deliberation, the jury announced itself hopelessly
deadlocked and unable to render a verdict.
Presiding Superior Court Judge William Uayes set October
12 as the retrial date over objections from defense attorney Charles
Garry who said he "will not be there" for the third trial.
DANIEL ELLSBERG lost his appeal yesterday and has been
Wdered to face charges in California for unauthorized possession
of secret government documents.
In his ruling, Appelate Judge Frank Coffin upheld the de-
cision of district court Judge Arthuf Garrity who ruled last week
' that Ellsberg be removed to California for arraignment August 16.
Ellsberg, a senior research associate at Massachusetts Insti-
tute of Technology is charged with the unauthorized possession
of the Pentagon papers which he said he released to various
newspapers in June.
PAKISTAN' claimed yesterday to have killed 72 Indian
' troops in repelling an attack across the border in the northern
sector of East Pakistan.
The report claimed the Indian forces crossed the border into
Pakistan but "even under this grave provocation our troops did
not across the border in pursuit."
Indian government sources responded that the report was "a
complete fabrication" denying that Indian troops had crossed the
border of East Pakistan.
A CITIZENS COMMITTEE charged with reviewing the 1970
census has urged the government to maintain "creative vigilance"
in keeping census records confidential.
Because of the rapid increase of information gathering made
possible by technological innovations, the panel said, "the gov-
l ernment's guarantee of confidentiality must continue to be ab-
solute."
As a first step, the panel said, the Census Bureau should
name an advisory committee on privacy and confidentiality repre-
