Swiss Want Suit
Dismissed

The Swiss government has
jumped into the suit filed by
Holocaust survivors against
Swiss banks, asking a federal
judge to dismiss the litigation
because it "will interfere" with
Swiss efforts to help Holocaust
victims and their families.
In addition, the Swiss Em-
bassy in Washington asked the
U.S. State Department to "take
all appropriate steps" to urge
the court to "apply moderation
and restraint" in its handling of
the suit. There has been no re-
sponse by the State Depart-
ment.
But in an affidavit to the
court, Sen. Alfonse D'Amato, R-
N.Y., urged the suit to continue,
saying the claims and relief
sought "are far broader than
any of the informal investiga-
tions that have been estab-
lished (or attempted to be es-
tablished) by the Swiss
government or the Swiss banks
to address this problem in
Switzerland."
D'Amato's affidavit came two
weeks after Swiss Ambassador
Alfred Defago wrote to Brook-
lyn Federal Judge Edward Kor-
man contending that "the most
effective and just means for
dealing with these matters are
in Switzerland, not in a United
States court ... The government
of Switzerland believes that
continuation of these lawsuits
would be inconsistent with
proper respect for Swiss sover-
eignty under internationally
recognized legal principles. ❑
