ACCORDING TO the appeals court,
Russell's stepdaughter, her children
and her husband, Ronald Rupert, had
been living with him for two years,
paying monthly rent.
Russell-who had asked the family to
leave-claimed they were in arrears on
the rent and that Rupert had waved a
meat cleaver around and threatened to
burn the house down if his wife was for-
ced out. The elderly man said Rupert
was rushing into a room where he kept
the cleaver at the time of the shooting.
THE APPEALS court agreed a
Detroit Recorder's Court judge gave
confusing instructions to the jury on the
issue of self-defense.
But, it said, iThe evidence com-
pellingly establishes that the decedent
(Rupert) was not armed and, indeed
was attempting to get away from the
defendant at the time he was shot in the
back.
"No reasonable juror could have
found that . .. defendant acted in self-
defense," it said.
