Russell-who had asked the family to leave-claimed they were in arrears on the rent and that Rupert had waved a meat cleaver around and threatened to burn the house down if his wife was for- ced out. The elderly man said Rupert was rushing into a room where he kept the cleaver at the time of the shooting. THE APPEALS court agreed a Detroit Recorder's Court judge gave confusing instructions to the jury on the issue of self-defense. But, it said, iThe evidence com- pellingly establishes that the decedent (Rupert) was not armed and, indeed was attempting to get away from the defendant at the time he was shot in the back.
