Picketing workers suspect

scam in store sale

The ongoing dispute over the mysterious sale
of Cunningham's drugstores has left fired em-
ployees determined to continue their three-
month old picket until the National Labor
Relations Board issues a decision on the case at
the end of the month.
Controversy arose over the sale in late June,
when 29 Michigan Cunningham's (four in the

Ann Arbor area) were abruptly closed and then
reopened under the name Apex Drugs Inc. Just
before the sale, Cunningham's fired all union
employees, keeping only non-union
management position workers.
APEX HAS not rehired the fired employees.
Union officials immediately yelled foul,
claiming that the sale was blatant "union
busting." Apex and Cunningham are exactly

the same company with different names, the
union said.
Recently, information has emerged to sup-
port the union claims.
CUNNINGHAM'S is privately owned by the
CD Holding Co. Two shareholders in CD
Holding, Mickey Shapiro and Spencer Patrich,
also own 75 percent of Apex, a connection that
union members claim makes the sale a

"scam."
Apex President James Devine, formerly vice,
president of Cunningham's, insists that Apex
remained financially separate from CD
Holding throughout the transaction.
"It is true that two officials of Apex (Shapiro
and Patrich) own 6.25 percent (each) of CD
Holding corporation.. . but they had no money
involvement with the Apex-Cunningham tran-

saction," Devine said.
THE UNION has filed three complaints witih
the Detroit NLRB, which has promised a
response by the end of September, said Jimn
Stevens, a board Attorney.
One of the union complaints, requiring Cune
ningham's to release details about the sale an4
