'U', EMU differ
on room searches

An Eastern Michigan University (EMU) student who claims
campus detectives and a dormitory sthff member illegally
searched his room has filed a $355,000 suit against EMU.
But officials here say there is little chance of such an occur-
ance at this University.
EMU suspended Thomas Eddmgs in February for one year after
two campus detectives and a dormitory staff member searched
his room and allegedly fouund marijuana.
CAMPUS SECURITY officers here say they do not make as
intensive an effort as their EMU counterparts to crack down on
students who have marijuana in their dorm rooms.
"We don't do periodic searches looking for marijuana," Direc-
tor of Campus Security Frederick Davids said.
"I'm not saying we condone it, but we aren't going to do any-
thing illegal (to catch users and dealers)," he added.
DAVIDS SAID University security officers would enter a
room only under two conditions: if they knew a felon was in the
room or if they had prior knowledge and obtained a search war-
rant from a magistrate. Only then will the officer enter and
search the room, Davids said.
"The officer rightfully has lawful authorization to search the
immediate surroundings. This is to protect the officer," from
accesable weapons, he said.
Davids stressed that immediate surroundings did not mean
an all-out, thorough earch.
"IF WE stopped someone in a car, we have the right to search
it, but we certainly can't search that person's home," he said.
"If we do conduct a search, you can be assured it will be done
legally," Davids added.
Joel Allen, night supervisor for housing security, said whether
or not officials enter a room and search it depends on the indi-
vidual situation.
IF A ROOM was on fire, someone was injured, or any simi-
lar emergency took place, housing security would enter the room
to help, Allen said.
He said if an obvious violation of housing regulations had
been observed by a housing security person - presence of burn-
ing candles or cooking equipment, for example - the room could
be entered.
"The housing director has the right to check the building for
fire hazards,",Allen said.
