Economics with no prior criminal record, charged by
prosecutor with ticket scalping for selling 2 UM/MSU
football tickets for a total of $3 over face value. After
arrest, defendant posts $100 bond and pleads not guilty.
Court arraigns defendant on charge. First pre-trial hear-
ing. Second pre-trial hearing on 2-page motion to dis-
miss by defendant's attorney.. Third pre-trial hearing
with filing of defendant's 15-page brief for dismissal.
Fourth pre-trial hearing to grant prosecutor extension of
time to prepare answer. Fifth pre-trial hearing with fil-
ing of prosecutor's 7-page brief. Sixth pre-trial hearing
with Court's 6-page opinion denying defendant's motion
and to set case for jury trial. On day of trial, defendant
with attorney appears in court but there are no witnesses
for the prosecution. Six months after charges first
brought-CASE DISMISSED.
Because the prosecutor ties up the time and resources of
the police, courts and his own office with cases like this,
tax-dollars are wasted and serious cases must be plea-
bargained for administrative convenience or are dis-
misseo1 for lack of preparation. More than 1700 serious
felony cases a year must be handled by the prosecutor's
