payroll tax — we would offer a
certain dollar amount based on the
financial criteria and, if you meet
them, the state will, mirroring the
IRS guidelines, potentially accept
the offer.
IN: Are there other circumstanc-
es where you may qualify?
LL: If there's doubt as to liability
— you doubt the debt is accurate
or the assessment was wrong, or
you may not be the person liable.
Alternatively, if the IRS accepted
an offer in compromise for the
same tax period, the state will
grant a proportionate offer in com-
promise, and there are a number
of formulas behind that, but many
of the details are yet to be deter-
mined because the program is only
weeks old.
IN: With these new options to
handle problematic state tax
debts, who do you think will take
advantage of this program?
LL: Our office deals with everyone
from doctors to lawyers to retail
business owners to restaurants
to independent contractors, like
plumbers and electricians — liter-
ally anyone with tax problems.
That can mean folks who owe
$50,000 or $500,000 or $5 million.
Our job is to resolve the problem.
While not every client will qualify
for the offer in compromise pro-
gram, whether that's state or fed-
eral, it's all based on the financial
criteria and the condition of the
taxpayer.
