Fanego agrees that is what his client
is looking for.
"Through her eyes, she sees this as a
freedom of speech case," he said. "In
her mind, she thought she was doing
people a favor by giving them the pam-
phlet."
Wilson, at the initial appearance in
court on Aug. 5, pleaded guilty on the
condition that the pamphlets taken
from her car be returned to her.
Frankel refused to accept the plea with
conditions. Hopkins pleaded guilty,
and is awaiting sentencing.
Following the judge's denial of the
motion, Fanego moved to have the
pamphlets returned to Wilson, stipu-
lating that the ones taken off the lawn
would be forfeited. Joseph Longo, the
attorney representing the city, agreed.
The next step is a Jan. 20 pre-trial,
which will determine if the case will
go to trial.
"It's a simple case: Either she lit-
tered or she didn't," said Eugene
Lumberg, city prosecutor. "I'm ready
to try it, if need be."
Before the pre-trial, Wilson can
plead guilty or no contest to the mis-
demeanor charge of littering.
"There is no guarantee that she will
still go through with the trial now that
she has her materials back," Frankel
said. "There's nothing to stop her
from pleading out, but she doesn't
know the sentence.
"I hope that it does go to trial,
because it's important that the com-
munity speaks to it, and that the mat-
ter be publicly explored." ❑
