"It's a simple case: Either she lit- tered or she didn't," said Eugene Lumberg, city prosecutor. "I'm ready to try it, if need be." Before the pre-trial, Wilson can plead guilty or no contest to the mis- demeanor charge of littering. "There is no guarantee that she will still go through with the trial now that she has her materials back," Frankel said. "There's nothing to stop her from pleading out, but she doesn't know the sentence.
