sion, cities had to transport dis-
abled children to public schools
or provide mobile facilities out-
side of the religious schools.
In a brief supporting an ear-
lier request by New York City to
reopen the case, Solicitor Gener-
al Walter Dellinger argued that
the decision has adversely af-
fected the ability of school dis-
tricts to provide vital services to
the disabled, and added enor-
mously to the expense.
Marc Stern, legal director of
the American Jewish Congress
and a leading church-state sepa-
ration advocate, argued that the
meaning of the Justice Depart-
ment action was unclear.
"The Department of Education
has made it clear that it wants to
see Aguilar overruled," he said.
"The case is part and parcel of
what we've come to understand
as church-state separation; the
question is, what would the court
replace it with? Could we end up
with something much worse if we
begin revamping church-state
separation law?"
Good, Bad News
On Hate Crimes
This week's FBI announcement
of the latest hate crimes statis-
tics was a good news/bad news
kind of story.
The bad news first: According
to the data, the total number of
hate crimes increased some 40
percent in 1995 over the previous
year; of some 8,000 incidents of
vandalism and violence, some
1,058 were directed at Jews.
But the news may not be as
bad as it seems; in part, the in-
crease reflects the growing num-
ber of law enforcement agencies
that are paying attention to the
Hate Crimes Statistic Act, a law
passed in 1990 mandating the
collection of data on crimes based
on racial, religious or ethnic big-
otry. That law was passed after
heavy-duty lobbying by Jewish
groups such as the Anti-Defama-
tion League.
The problem is that the gov-
ernment never appropriated any
money for the data collection; as
a result, local law enforcement
agencies have not been rushing to
seek out the required information.
"The important fact is that the
number of agencies reporting on
hate crimes is significantly up
from last year," said Michael
Lieberman, deputy director of
ADL's Washington office. 'That's
a welcome development because
it reflects the importance of en-
couraging state and local author-
ities to contribute to the baseline
on hate crimes we are building."
