SUMMARY NOTICE OF PENDENCY OF
CLASS ACTION. PROPOSED SETTLEMENT AND HEARING
TO: ALL PEOPLE WHO OBSERVE THE LAWS OF KASHRUT AND WHO PURCHASED
AND/OR DRANK ANY NONKOSHER SNAPPLE BRAND BEVERAGE FLAVOR, INCLUDING
BUT NOT LIMITED TO PINK LEMONADE, FRUIT PUNCH; GRAPEADE, KIWI STRAWBER-
RY COCKTAIL, OR MANGO MADNESS COCKTAIL, AFTER SEEING THE "CIRCLE K"
SYMBOL ON CANS OR BOTTLES OF THE PURCHASED FLAVOR ON FACINGS ON THE
FRONT OF A VENDING MACHINE, ON BUTTON STRIPS FOR THE PURCHASED FLAVOR
ON A VENDING MACHINE, OR ON SOME OTHER DISPLAY, DURING THE PERIOD
BETWEEN MARCH 1, 1992 AND THIRTY DAYS AFTER THE LAST PUBLICATION OF THIS
NOTICE (THE "CLASS").
Notice is hereby given of a class action lawsuit that may affect your legal interests.
YOU MAY BE IN THE CLASS OF PEOPLE DEFINED ABOVE COVERED BY A PROPOSED
SETTLEMENT OF THIS CLASS ACTION. YOUR RIGHTS MAY BE AFFECTED BY THIS LITI-
GATION AND YOU MAY BE ELIGIBLE TO RECEIVE THE BENEFITS OF THE PROPOSED
SETTLEMENT OF THIS LITIGATION IF YOU FILE A VALID PROOF OF CLAIM FORM.
The proposed settlement in this litigation, which includes a release of claims, provides for a fund of
between $227,000 and $277,000, less certain fees, expenses, and payments which may be approved by the
Court, as well as 100,000 coupons redeemable for Snapple beverages, that can be used for the benefit of
the members of the Class. Not all of the money and coupons may be distributed to the Class.
On October 11, 1996 at 2:00 p.m., Magistrate Judge Viktor V. Pohorelsky will hold a hearing in
Courtroom 102 of the United States District Court for the Eastern District of New York, 2 Uniondale
Avenue, Uniondale, NY 11553, to determine (1) whether to approve the proposed settlement and dismiss
the lawsuit on the merits; (2) whether a proposed plan of allocating the proceeds of the settlement should
be approved; and (3) whether applications for attorneys' fees, costs, and expenses by the attorneys repre-
senting the Class should be approved. All Class Members will be bound by the Orders of the Court.
THIS NOTICE IS JUST A SUMMARY. If you believe you are a Class Member, you are urged to
contact Class Counsel at the phone number or address below to obtain a Proof of Claim and Release
Form and the detailed "Notice of Pendency of Class Action, Proposed Settlement and Hearing" (the
"Detailed Notice"), which sets forth additional information regarding the legal rights and obligations of
Class members, class certification, the proposed settlement, and the settlement hearing:

Proof of claim and Release Forms must be completed and submitted in the manner described in the
Detailed Notice no later than thirty days after the last publication of this notice. If you believe you are a
member of the Class, you may request exclusion from the Class in the manner described in the Detailed
Notice. Any requests for exclusion from the Class, any objections to the terms of the proposed settlement
or proposed distributions from the funds established by the proposed settlement (including for attorneys'
fees), and any individual attorney appearances must be filed no later than thirty days after the last publi-
cation of this notice, in the manner described in the Detailed Notice. The rights and obligations of Class
members and of persons requesting exclusion from the Class or objecting to the proposed settlement are
set forth in the Detailed Notice.
