But why has it continued for
another 45 years under the
State of Israel?
"The inertia of the system,"
said Mr. Simchoni. "And
putting debtors in jail makes
money for a lot of people. The
police get 70 shekels (out of the
debt payment made by) every
debtor they arrest. The lawyers
for the debtors and the creditors
make a tremendous amount of
money."
It all takes place in the Ex-
ecutive Division. Here, in little
hearing rooms in Magistrates
Courts around the country, qua-
si-judicial figures called regis-
trars stamp out hundreds of
thousands of arrest warrants
for debtors every year. Police
gather up as many warrants as
they can handle, arrest the
debtors — often in the middle
of the night — and bring them
back, usually the following
morning, to the Executive Di-
vision.
There the registrar offers the
arrestees a debt-repayment
schedule.
If they can make the pay-
ment that day, they go free. If
they can't, they go back to jail
and sit there for 21 days, or un-
til they can raise the money.
Each missed payment of each
unpaid debt carries another
maximum 21 days; this is how
some people can end up spend-
ing months and months on end
behind bars.
On a recent morning in Tel
Aviv Executive Division, about
30 debtors were brought in by
police after spending the night
in custody. None of them had
lawyers. They weren't in hand-
cuffs, but two debtors had to ask
permission from a guard to go
to the bathroom. They were es-
corted there by a policeman.
The registrar, a pleasant-
looking woman named Nurit
Ahitov, spent one minute, two
minutes, never more than three
hearing the story of each de-
fendant. With one debtor stand-
ing before the bench, I heard
snatches of dialogue that sound-
ed like:
"You owe 76,000 shekels...I've
been unemployed since
June...The first payment would
be 6,000 shekels. How much
can you pay?... I've brought 240
shekels with me...That's not
enough."
Ms. Ahitov told the man to
take his seat, and wait until she
gave her decision. The man
walked back from the bench
looking overwhelmed.
He said he'd already spent
a night in jail two years before
for owing the same amount on
the installation of the same
phone. "I went to jail end I paid
it. Now they arrest me again for
the same bill," he said. 0
