Court Refuses
Pledge Challenge

- Washington (JTA) — Rejec-
ting arguments made by an
atheist, the Supreme Court
this week refused to review a
case challenging the con-
stitutionality of reciting the
Pledge of Allegiance in
' public elementary schools.
The plaintiff, Robert
Sherman, whose son attends
,\_7. public schools in Wheeling
Township, Ill., argued that
daily recitations of the
pledge, mandated by Illinois
law, violate the First
Amendment clause calling
for separation of church and
state, . since the pledge in-
cludes the words "one nation
under God."
Lower courts had rejected
Mr. Sherman's argument,
and the high court left those
rulings intact when it an-

Robert H. Bodzin, Funeral Director

nounced, without comment,
that it would not review the
case, Sherman vs. Commun-
ity Consolidated School
District 21.
"I'm not surprised," said
Samuel Rabinove, legal di-
rector of the American Jew-
ish Committee, who said his
group had not been involved.
"We have never had ab-
solute separation of church
and state, and I doubt if we
ever shall," he said.
Mr. Rabinove pointed to
the "In God We Trust"
motto on American currency
and the fact that there are
chaplains in the U.S. Con-
gress and the military, as
other examples.
"The question is, where do
you draw an intelligent
line?" Mr. Rabinove said.
