Judge Upholds
Right To Die

Tel Aviv (JTA) — A Tel
Aviv District Court judge
0 has upheld the right to die.
But the ruling last week by
Judge Moshe Talkam will
have to be tested in the
courts.
It is sure to be opposed by
Orthodox Jews and social
conservatives.
The issue arose in the case
of Miriam Zadok of Ashdod,
a 50- year-old victim of ir-
reversible Alzheimer's
disease, who, in a tape
recording she made two
years ago, asked to be allow-
ed to "die with dignity" if
the time came when she
could no longer live without
artificial life-support
systems.
Her husband, Yehoshua
Zadok, brought the tape to
court to support the family's
request for an injunction to
prevent a nursing home
where his wife is confined
from putting her on life-
support systems.
Miriam Zadok, a super-
visor at the Ashdod tax au-
thority, developed the first
signs of Alzheimer's four
years ago and made the tape
in the presence of her hus-
band, sons and the family
lawyer while still in posses-
sion of her faculties.
Her condition worsened
thereafter and she had to be
placed in a nursing home.
Family members on Sunday
told Israel Television that
they fully support her deci-
sion.
Yehoshua Zadok says his
wife is utterly dependent on
others and can no longer
recognize him. He sought an
injunction when the nursing
home management informed
him that they would be
obliged to attach her to life-
support system unless they

had a court order to the con-
trary.
The system has not yet
been attached.
The judge ruled that the
;=--- nursing home, or any
hospital to which the patient
may be transferred, must
not put her on a respirator or
other artificial device that
performs life-saving func-
tions.
But they must administer
treatment to ease suffering,
such as pain-killing medica-
tion and oxygen.
The injunction is tem-
porary, however, and will
have to be considered by a
panel of judges. The Or-
thodox are expected to try to
quash it on grounds that the
human body belongs only to
God and cannot be disposed
of by its mortal occupant.
