REAL ESTATE
UPDATE

Ray A. Fox, Licensed Realtor

EMINENT DOMAIN

QUESTION: My town
wants to build a highway
and my house is in the way.
Can it take my property
without my consent?

ANSWER: I'm afraid the
answer is . . . YES! It can do
it by the power of eminent
domain. This is the right of
the government to take
private property for public use
with just compensation paid
to the property owner. The
town does not need the
property owner's consent.
The town will appraise the
property and offer you the fair
market price for it. If this
amount is not acceptable, you
have the right to recourse in
court to challenge the price
but not the taking.

IF YOUR PROPERTY is taken
by eminent domain, you must
receive just compensation.
