for museums, including a
compromise amount of
$87,000 to the HMC.
Despite their fears that
Mr. Engler would veto any
supplementary budget line
items for the arts, several
legislators, including repre-
sentatives Maxine Berman,
D-Southfield; and Barbara
Dobb, R-Commerce
Township; and senators
Lana Pollack, D-Ann Arbor;
David Honigman, R-West
Bloomfield; and Jack Faxon,
D-Farmington Hills, had
asked their colleagues to
reinstate HMC funds.
"I'm very happy that the
Holocaust Center will get
the money," Ms. Berman
said. "A lot of legislators
worked very hard to make
sure this happened."
"We worked hard with the
rabbi to secure these funds,"
added Mr. Honigman. "I'm
quite happy. Now he can
rest."

the Michigan Equity Pro-
gram, which was abolished
by Gov. Engler shortly after
he took office. Several legis-
lators, unhappy with his
proposed cuts to the arts,

judicial sentence today ends
a two-year ethnic intimida-
tion suit against a former
employee who spray-painted
anti-Semitic slurs on the
back of their Birmingham
Wells Freight and Cargo
store.
Garrick Anthony Brown-
ing, 19, was charged in 1990
with one count of ethnic in-
timidation and one count of
conspiracy to commit ethnic
intimidation in connection
with the Dec. 9, 1989, inci-
dent.
Ethnic intimidation is a
felony punishable by up to
two years in prison or a fine
of up to $5,000.
Mr. Browning appears
before Oakland County Cir-
cuit Judge Deborah Tyner
March 27 because of a. viola-
tion in the terms of his pro-
bation. He has failed to meet
the terms of an 18-month
probation by not paying
$480 in damages and fulfill-
ing 200 hours of community
service, according to Oak-
land County Chief Assistant
Prosecutor Gerald D.
Poisson.
In July 1990, 48th District
Judge Thomas Brookover
refused to order Mr. Brown-
ing to Circuit Court on the
charge, saying he believed
the defendant painted the
graffiti out of anger over los-
ing his job, and not strictly
as an ethnic attack.
"The statute requires that
a person must be harassed
solely because of the per-
son's ethnic origin," the
judge said at Mr. Browning's
preliminary examination.
Judge Brookover reduced
the charge to malicious
destruction of less than $100
and dismissed a charge of
conspiracy to commit ethnic
intimidation. The judge's
decision was later overturn-
ed on appeal.
The Ethnic Intimidation
Act, a statute which took
effect March 30, 1989,
defines ethnic intimidation
as threats, physical contact
or property damage directed
at a person because of that
person's color, religion,
gender or national origin.
Mr. Browning's co-
defendant, a 15-year-old
Troy girl, was ordered to per-
form 100 hours of commun-
ity service at the Holocaust
Memorial Center in West
Bloomfield and to write a 25-
page report on the Holo-
caust. The girl said she
helped her boyfriend paint
anti-Semitic slogans on the
back wall of the store after
he was fired from his job.
The Oakland County pros-
ecutor's office had unsuc-
cessfully petitioned the ju-
venile court to charge the 15-
year-old also with ethnic in-
timidation and conspiracy.
