Creche Appeal
Is Turned Down

I

Cincinnati — A federal appeals
court has upheld a ruling that the
city of Birmingham, Mich. vio-
lated the U.S. Constitution's sep-
aration of church and state by
displaying a city owned nativity
scene on the front lawn of city
hall.
In a 2-1 decision on June 11, a
three-judge panel of the 6th U.S.
Circuit Court of Appeals rejected
city arguments that the creche
display at Christmas was only a
symbol of a holiday, not a gov-
ernment attempt to advance one
religion. The city is considering
an appeal to the Supreme Court.
