NY court freezes assets
from Sotheby's Judaica sale

New York (JTA) — A
state Supreme Court judge
Monday ordered Sotheby's
auction house to freeze all
assets from the sale last
June of a collection of rare
Judaica books and manu-
scripts thought to have been
destroyed by the Nazis in
World War II.
Judge Robert White also
ordered that a trial be held
to determine the rightful
owner of the manuscripts,
dating from the 13th
through 19th Centuries,
and that the international
auction house make avail-
able to Attorney General
Robert Abrams, who
brought the suit against
Sotheby's, a list of all indi-
viduals who purchased
materials at the June 26 au-
ction.

In his 11-page written de-
cision Monday, White ap-
peared to question
Guttmann's claim to owner-
ship of the materials. White
also appeared to question
whether he was given the
materials or whether he
was to only smuggle the
materials out of Germany.
"Upon the totality of the
eviddhce presented thus far,
it seems likely that Dr.
Guttmann was one of the
many individuals who, in
the Mosaic tradition, was
charged with the safe
transmission of the law and
culture of the Jewish
people," White wrote.
In concluding his deci-
sion, White added: "There is
every indication that rather
than share these master
works with other scholars
upon his arrival in this
country, he actively con-
cealed their existence.
These actions are not con-
sistent with a firmly held
belief in his rightful title,"
White said.
No date has been set for
the trial. Sotheby's said it
will comply with the re-
quest for all the names of
the purchasers to be
supplied to the Attorney
General's office.
The Attorney General's
office said it "is pleased by
the decision, and intends to
proceed immediately" with
gathering further informa-
tion from the auction house.
Sotheby's, which was re-
cently purchased by De-
troiter A. Alfred Taubman,
also indicated it was satis-
fied with the court's deci-
sion, saying, "We look for-
ward to providing as much
information' as possible."
The court action by White
is the latest development in
the running battle between
the auction house and the
Attorney General's office.
The auction was contested
when Jewish organizations
questioned the ownership of
the materials, many of
which came from a rabbini-
cal seminary in Berlin, The
College for the Scientific
Study of Jewish Culture.
It was revealed just two
weeks ago in an affidavit
filed by Sotheby's that the
alleged owners of the items
are Dr. and Mrs. Alexander
Guttmann. Dr. Guttmann,
82, is a professor at the Rab-

ville Janner, the head of the
British Jewish community,
warned this week of serious
dangers threatening the
position of Jews in Europe
from the extreme right and
the extreme left.
He pointed especially to
the. recent elections for the
European Parliament in
which "11 to 12 percent of
the, French electorate voted
fascist." Janner was refer-
ring to the elections last
June in which the National
Front, led by Jean-Marie Le
Pen, won 11 percent of the
vote.
Janner, president of the
Board of Deputies of British
Jews and a member of the
British Parliament, spoke
of the dangers facing Euro-
pean Jews at a meeting
Monday of the leadership of
30 American national
Jewish organizations at an
executive meeting of the
American Section of the
World Jewish Congress.
Pointing out that
"Americans have heard al-
most nothing" about the
electoral inroads made by
fascist parties in Europe.
Janner observed that, on
the other hand, "when Is-
rael voted 1.5 percent fas-
cist (referring to Meir
Kahane's election) every
newspaper in the world was
filled with it." European
Jewry was opposed to ra-
cists of any sort., he said.
Elaborating on the poten-
tial, dangers to Jews in
Europe, Janner pointed to
the sharp economic
downturn on the continent
which is pushing many of
the disadvantaged into ex-
tremist camps of the right
and left.. "The Jews have
always had their golden age
in time of prosperity, and to
me the long-term indica-
tions are bad," Janner said.
The threat from ter-
rorism, he said was rising
and spreading throughout

the world. "The PLO is an
international terrorist
emanation spreading
throughout the globe, and it
doesn't help the Jews to live
in terrorist times," he
added.
Finally, he suggested
that in Europe, as in much
of the rest of the world,
there is diminishing sym-
pathy for the Jewish condi-
tion, and this was also a rea-
son for his pessimistic out-
look. "The image of the
Holocaust is receding, so
that people no longer have a
guilt complex about the
Jews," Janner said.
Janner was recently
elected chairman of the
World Jewish Congress-
European Branch and was
in New York to brief Ameri-
can Jewish leaders on the
state of European Jewry. He
also reported on his recent
meetings with Prime Minis-
ter Indira Gandhi of India
and Prime Minister Robert
Mugabi of Zimbabwe.
