Washington — A federal
appeals court has reversed
the ruling by a lower court
that said the armed forces
could not prevent Jewish
personnel from wearing
yarmulkes.
The United States Court
of Appeals for the District of
Columbia, in a 3-0 decision
Tuesday, rejected
arguments that the mili-
tary rule violated the con-
stitutional right to freedom
of religion. "The free exer-
cise clause of the First
Amendment guarantees
both the freedom to believe
and the freedom to act, but
only the former is absolute,"
appeals court Judge Luther
Swygert wrote in the oppin-
ion.
The case was brought to
court by S. Simcha
Goldman, an Orthodox
rabbi who has served as a
chaplain in the Navy and
the Air Force since 1970.
