Bible Furnishes Gutdelines for Sale of Land in Israel

Some Jewish legal
sources forbid the sale of
real estate in Israel to non-
Jews.
The Talmud traces this to
the passage in the Bible
(Deuteronomy 7:2) which is
taken to mean that perma-
nent ownership of Israel
real estate by non-Jews is
forbidden. The Mishna cites
the law forbidding this
practice (Aboda Zara 19b).
Nachmanides explains
that such a transaction
would make it impossible to
return the land to its origi-
nal owner in the Jubilee
Year — something which is
required according to bibli-
cal law. Another rabbinic
source claims that the Jew

On the other hand,
there were some
authorities who claimed
that the restriction to sell
some real estate in Israel
to non-Jews applied only
to idol worshippers so
that they would not lead
the people to idol wor-
ship (Exodus 23:33). One
source indicates that this
would therefore not
apply to selling real es-
tate to Moslems, who are
considered monotheists.
Under most opinions, if
there is any restriction, it
would only apply to a per-
manent sale. In general, it
might be stated that the
concern was to insure that
the land of Israel remained
"a Jewish country."
