CLEVELAND (JTA) —
Records in the Federal Dis-
trict Court here reveal that
the defense attorneys for ac-
cused Nazi war criminal
John Demjanjuk will be
allowed to accompany Jus-
tice Department pro-
secutors to Germany next
month to take depositions
from two German witnesses
for an upcoming trial.
Demjanjuk is accused of
having been a guard at the
Treblinka death camp dur-
ing World War H.
Travel and maintenance
expenses of John Martin
and Spiros Gonakis,
lawyers for tht 59-year-old,
Ukrainian-born Demjan-
juk, will be paid by the U.S.
government. The identities
of the two German wit-
nesses are being kept secret
pursuant to an order by U.S.
Magistrate Jack Streepy.
It is known, however,
that the testimony of at
least one of them will be
video-taped and that the
recording of this tes-
timony will be replayed
during the trial.
The case is expected to
reach the courtroom of Fed-
eral District Judge Frank
Battisti as early as March.
Meanwhile, Sen. Edward
M. Kennedy (D-Mass.),
chairman of the Senate
Judiciary Committee, ex-
pressed "deep concern" over
developments hampering
the smooth functioning of
the Office of Special Inves-
tigations in the Department
of Justice, charged with in-
vestigating alleged Nazi
war criminals residing un-
lawfully in the United
States.
Commenting on recent
reports on personnel
changes in the Office of Spe-
cial Investigations in the
Criminal Division of the
Department, Sen. Kennedy
said:
"I am deeply con-
cerned over the sudden
transfer of Martin Men-
delsohn as Deputy Direc-
tor of the Office of Special
Investigations. It signals
that this office is still not
functioning smoothly
nor effectively enough
to accomplish the mis-
sion for which it was es-
tablished.
"World War II has been
over some 30 years, but we
hear even today of allega-
tions that Nazi war crimi-
nals remain free, living

To those people who out-
lived the horrors of Nazi
Germany, the continued
existence of these allega-
tions without adequate in-
vestigation, mocks the very
tenets of justice.
"The American govern-
ment owes those who died

many years of horror im-

these allegations, and ex-
peditious disposition of each
