N.Y. Jews Seek to Have
Burials on Legal Holidays

NEW YORK (JTA) —
Five major Jewish organi-
zations have asked that
New York state regulations
governing burials on legal
holidays be amended to ex-
tend opportunities for Jews
to bury their dead on such
days.
There has been in effect
for several years a little-
known state regulation re-
quiring cemeteries to pro-
vide burial for Jews on legal
holidays, when cemeteries
are usually closed, accord-
ing to Howard Zuckerman,
president of the National
Jewish Commission on Law
and Public Affairs. That
regulation was adopted by
the New York Cemetery
Board as a result of a
COLPA initiative, Zucker-
man said. The board is a di-
vision of the Department of
State.
The regulation, which
exists only in New York
state, provides that, with
respect to legal holidays, a
request for burial on such
holidays must be complied
with if the request is re-
ceived by cemetery officials
by the normal closing time
of the day preceding the
holiday.
the
of
Officials
cemeteries must comply
unless burial may be im-
possible because of the
condition of the grave-
site, such as the ground
being frozen, or the un-
availability of grave dig-
gers. Under the regula-
tion, the cemetery must, if
properly notified, make
"good faith efforts" to
comply with such a re-
quest and explain any re-
.

fusal to the Cemetery
Board.
One problem not resolved
by the regulation stems
from a death occurring after
the regular closing time of a
cemetery the day preceding
a legal holiday.
The amendment proposed
by the five Jewish organiza-
tions would extend the time
for such notification to 9
a.m. of a legal holiday and
require installation and use
of a telephone answering
service device at the cemet-
ery to make possible receipt
of and response to requests
for burials made by that
time, despite the cemetery
being closed, a spokesman
for the five agencies said.
The agencies are COLPA,
Agudath Israel, the Na-
tional Council of Young Is-
rael, the Rabbinical Council
of America and the Union of
Orthodox Jewish Congrega-
tions of America.

Switched Babies
in Real Homes

HAIFA—Two Israeli
babies are back with their
natural mothers two
months after they were
switched by mistake in
Haifa hospital.
Five doctors and nurses
will be charged with negli-
gence in the incident in
which three different
switches took place.

A committee set up to in-
vestigate the switch said
the mistake probably was
made by trainee nurses,
new immigrants to Israel,
who had trouble reading
Hebrew name tags.
