Massachusetts Rabbinical Court
Invalidates Ali Intermarriages

NEW YORK—The Rabbinical
Court of Justice of the Associated
Synagogues of Massachusetts, upon
completing a careful study of sev-
eral cases presented to it for dis-
position, has declared that a mar-
riage performed between a mem-
ber of the Jewish faith and a mem-
ber of another faith is invalid,
under Jewish law, even if such a
marriage is solemnized by a rabbi.
The cases presented before the
rabbinical court for disposition in-
volved an interfaith marriage in
which a rabbi officiated and a
similar case in which a rabbi and
a clergyman of another faith offi-
ciated in a joint ceremony.
In declaring such marriages null
and void under Jewish law, the
Rabbinical Court of Justice con-
demned the action of such clergy-
men as irresponsible and a be-
trayal of the Jewish faith and the
Jewish people.
The court also called upon rab-
binic organizations in the area
to take disciplinary action in
expelling from membership such
individuals involved in the per-
formance of interfaith marriages
in order to indicate to the Jew-
ish community and the public at
large the solidarity of the rab-
binate — Orthodox, Conservative
and Reform—"in exercising its
responsibility of safeguarding
the entity of the Jewish people
and preserving the survival of the
peoplehood of Israel."

The statement of the rabbinical
court emphasized that a convert
to the Jewish faith who meets the
requirements of Jewish law should
be accorded equal rights and equal
involvement in Jewish identity, but
at no time "should a marriage
be performed between a Jew and
a non-Jew on the supposition that
the non-Jew will eventually con-
vert." Marriage should not be
used as a medium for capturing
souls or forcing conversion," said
the court.
It added, "It is important that
we protect the right of every in-
dividual to live in accordance with
his faith and never permit condi-
tions or situations to arise that
would compel a member of an-
other faith to convert to Juda-
ism."
"We are living in a free democ-
racy," observed the rabbinical
court, "where religion and state
are completely separated, and it
is conceivable for two young peo-
ple of different faiths to unite in
marriage in accordance with the
laws of the Commonwealth of Mas-
sachusetts in a civil ceremony.
But to have such a union solemn-
ized by a rabbi in order to give
it religious status and religious
identity constitutes a sham and
a fraud which that Hebrew clergy-
man would be perpetrating on the
parties concerned."
Later a spokesman disclosed
that the court is seeking a ruling
from the state attorney general
on whethter a marriage performed
by a rabbi which is invalid under
Jewish religious law is valid under
civil law. The spokesman said that

such a marriage is invalid under
civil law, it would apply to future
