Fortner SS Official
Freed as Insane;
Stangl on Trial

BONN (JTA) — A three-year-old
Nazi war crimes trial, the longest
on record, has ended with the
acquittal of the chief defendant on
grounds of insanity and the sen-
tencing of two others to prison
terms of moderate length.
The attorney general had de-
manded life impristiument for all
three for war crimes committed
at the notorious Buchenwald con-
centration camp.

The court freed former SS bat-
talion leader Heldmut Bishop who
was certified as medically insane
and was dragged screaming front
the courtroom.
An 8:2-year sentence was im-
posed on former SS officer Erwin
Busta. 84, and a 7 ,.r-year sentence
on Ernst Sander. 56.
Both were convicted of abetting
murder in two separate instances.
and Busta was also found guilty
of attempted murder.
The trial began on Nov. 7, 1967.
Three hundred witnesses were
• heard, among them Hitler's for-
mer armaments minister. Albert
Speer who was recently freed from
Spandau prison.
The judges and attorneys tra-
veled to Poland. Russia. France
and the Netherlands during the
course of the trial to hear testi-
mony.
In Dusseldorf, the trial of Franz
Paul Stangl, former commandant
of the Treblinka and Sobibor death
camps in Poland, resumed after a
week-long recess called when the
defendant became ill.
Stangl, 62, a former SS officer.
admitted that the SS trained death
ca mp personnel before sending
them on assignment. He said he
had volunteered for police duty in
Poland and was first sent to
Sobibor, where three gas chambers
were installed. Stangl, who was
tracked down in Sao Paulo. Brazil.
in 1967, is charged with responsi-
bility for the deaths of 490,000
persons.
He has pleaded that he merely
did his duty as a commandant ful-
lowing orders. His trial is expected
to last four months.
The former SS officer told the
court that accomplices dressed as
rabbis greeted Jews at a fake train
depot at Treblinka and assured
them it was only a half-way sta-
tion. The "depot" was actually the
Treblinka receiving room, fitted
with misleading ticket counter and
clock, he admitted. "But the clock
was only painted on," he said. "It
always said three o'clock."
A spectator in the court was ,
Simon Wiesenthal, director of the
Nazi war crimes documentation
center in Vienna, who flushed
Stangl out of his haven in Brazil
three years ago. Wiesenthal told
newsmen, "In my eyes he is the
number three Nazi war criminal
after Martin Bormann and Gestapo
chief Mueller, if they are still
alive." .
