Property Covenant Restrictions
Against 'Semitic Race' Invalidated
A decision declaring invalid a
property covenant restricting
against ownership or occupancy
by members of the "Semitic race"
was handed down this week by
the Circuit Court of Oakland
county. The opinion was received
by Nathan Milstein and Paul J.
Weisselberg, chairman and co-
chairman respectively of the
Legal Committee of the Jewish
Community Council, which had
participated in the case from its
beginning. The pleadings in the
matter were prepared by Harry
M. Nayer, assisted by John Sklar,
of the Council's Legal Committee.
In the Oakland case, Najib Fer-
ris, a native of Syria and a U. S.
citizen for the past 25 years, had
purchased and was occupying a
home in Highland Township with
his son, Dr. Alfred Ferris. The
complainant in the matter charged
that because Ferris was a
"Semite" he was occupying the
property in violation of the re-
strictions, and sought to enjoin
him from such occupancy.

LAKE SUCCESS (JTA)—The
World Jewish Congress submitted
to the Drafting Committee of the
U.N.
Commission on Human
Rights a memorandum containing
several proposals which it urged
be incorporated in a resolution
to be submitted to the General
Assembly as a first step- towards
an International Bill of Rights.
The proposals, which the Con-
gress emphasized are not a sub-
stitute for a Bill of Rights, sug-
gest that the General Assembly
take the following steps:
1. Alttrin the obligation of all mem-
ber states of the United Nations to
ensure equality before the law for
all their inhabitants "without distinc-
tion as to race, sex, language or re-
ligin. -
2. Request all member states to
enact without delay, and in accord

3 Call on them, not merely to
prevent ,retractions of this legislation,
but to take positive and continuous
action to insure that it is fully and

Ask U.N. to Aid Return of
40.000 Jewish War Orphans
NEW YORK (JTA)—An appeal
for legislation to force the return
to the Jewish community of an
estimated 40,000 Jewish children
still in Christian foster homes
throughout Europe will be made
to the U.N. Commission on Hu-
man Rights by the Commission
on the Status of Jewish War Or-
phans in Europe, it was revealed
here by Dr. Isidor Grunfeld,
chairman of the commission, who
arrived to this country from Lon-
don.

Colonial Secretary Refuses
To Suppress Jewish Agency
LONDON. (JTA) — Colonial
Secretary Arthur Creech-Jones
rejected a demand by Richard
Stokes, labor, that the Jewish
Agency be suppressed because it
advocates the use of force to
further illegal immigration into
Palestine.

testimony before the court that
the term "Semitic race" is vague
and meaningless and has no sig-
nificance in a contract conveying
property. Other testimony before
the court revealed that the corn-
plainant had no concept whatso-
ever of the meaning "Semitic."
Going beyond the vagueness of
the term, the Community Coun-
cil's statement to the court
stressed the issue of public policy.
Various legislative enactments of
the State of Michigan prohibiting
discrimination because of race or
color were brought to the court's
attention.
It urged the court to decide
whether the enforcement of such
a covenant would be "conscion-
able and constitutional" and point-
ed out that the effect of enforce-
ment of such a covenant would
bring about "that which the legis-
lative and executive departments
of the state are powerless to ac-
complish" because of constitu-
tional and statutory safe-guards.
Concluding that a decree for the
complainant "would be in viola-
tion of the Constitution of the
United States and would be con-
trary to the public policy of the
State of Michigan," the Council
asked for dismissal of the com-
plaint.
The decision of the court de-
claring the covenant invalid was
rendered by Circuit Judge H.
Russell Holland.
