clam was heard because the Con-
stitution did not furnish a more
unequivocal religious f reed o
guarantee. From Paris, where he
was serving as ambassador to
France, Thomas Jefferson wrote
that he did not like "the omission
of a bill of rights, providing
clearly and without the aid of
sophisms for freedom of religion,
freedom of the press, etc. . . ."
Throughout the debates in all the
States demands were voiced for
some restriction upon the Federal
government with respeet to leg-
islation regarding religion. Many
outstanding leader o, including
Patrick llenry and James Mon-
roe, opposed ratification on this
ground. Others, again, resented

the provision against a religious
test, voicing the fear that it
would enable Jews, Catholics,
Turks and infidels to hold public
office and might permit the Pope
to become president. These ex-
treme objections came mostly
from laymen, while the clergy
heartily agreed with the ban on
religious tests. Ratification of the
Constitution by the required nine
States was achieved only on the
understanding that the first Con-
{cress to be elected under the Con-
stitution would add to that docu-
ment a bill of rights containing
a gurantee of religious liberty. ,
To James Madison was given
the task of drafting the bill of
rights. On June 8, 1789, five
weeks after Washington was in-
augurated as the first President,

he submitted to Congress a series
of proposed constitutional amend-
ments. The one dealing with reli-
gious liberty read as follows: "1
—The civil rights of none shall
be abridged on account religious
belief or worship, nor shall any
national religion be established,
nor shall the full and equal rights
Oj conscience be in any manner
or on any pretext infringed. 2.—
No state shall violate the equal
rights of conscience or the free-
dom of the press. or the trial by
jury in criminal cases." This
phraseology met with consider-
able objection in the House of
Representatives, and a committee
was appointed to rephrase the
amendment.
On July 28, 1789, the commit-
tee reported a new draft which
changed the first clause to read:
"No religion shall be established
by law, nor shall the equal rights
of conscience be infringed." Af-
ter some debate this was further
amended to read: "That Congress
shall make no laws touching reli-
gion or infringing the right of
conscience." In this form, and
with the second clause, restrain-
ing the States from curbing reli-
gious freedom, the amendment
was passed in the House, but not
by the Senate. On Aug. 20 a com-
promise was reached: "Congress
shall make ng law establishing
religion or to prevent the free
exercise thereof, or to infringe
the rights of conscience." But
even this form failed to meet with
general agreement, and not until
the present words of the amend-
m e n t were reached—"Congress
shall make no law respecting an
establishment of religion, or pro-
hibiting the free exercise thereof;
or abridging the freedom of
speech or of the press; or the
right of the people peaceably to
assemble and to petition the gov-
ernment for a redress of griev-
ances"—was it finally passed by
both House of Congress and sub-
mitted to the States.
G e o r g i a, Massachusetts and
Connecticut never ratified this
First Amendment. the two last-
nsmed actually rejecting it. But
by Dec. 15, 1791, enough States
had ratified the bill of rights to
make it an integral part of the

United States the first country in
the world to realize constitutional
religious liberty. Of this liberty
George Washington said:
"If I could have entertained

the slightest apprehension that
the Constitution framed In the
convention, where I had the
honor to preside, might possibly
endanger the religious rights of
any ecclesiastical society, cer-
tainly I should never have placed
my signature to it; and if I could
now conceive that the general
government might ever be so ad-
ministered as to render the lib-
arty of conscience insecure, I beg
you will be persuaded that no
one would be more zealous than
myself to establish effectual bar-
riers against the spiritual tyranny
and every species of religious
persecution."

Jews Flee German Upper Silesia
As Minority Pact Lapses

Silesia (WNS) — Carrying with
them as much of their movable
property as possible, hundreds of
Jews poured into this city from
Beuthen and other towns in the
Germa npart of Upper Silesia as
Germany assumed full sovereignty
over that area with the expiration
of the Polish-German convention of
1922 which guaranteed minority
rights to residents of both Polish
and German Upper Silesia. Exact-
ly at the moment that the conven-
tion lapsed, the anti-Semitic legis-
lation in effect in Germany was
applied in German Upper Silesia
and Julius Streicher's Steurmer,
hitherto barred, made its appear-
ance on all news-stands. In a spe-
cial edition the paper announced
its determination to waste no time
who remain in German Upper
in getting revenge over all Jews
Silesia.
