Tax on Gifts Curbed by Su
preme Court.

Holds Gifts Within Two Years of
Death Not Conclusively Taxable.

The Supreme Court March 21
held unconstitutional that part of
the revenue law of 1926 which pro-
vides that transfers of property
within two years before death shall
arbitrarily be held to have been
made in contemplation of death."
The court's decision were in two
cases, in each of which an opin-
ion by Justice Sutherland held that
"the presumptive conclusion that
the transfers were anticipatory of
death violated the Fifth Constitu-
tional Amendment."
Justice Stone and Justice Bran-
dies dissented in each instance.
Justice Cardozo took no part in the
cases.
The cases were that of D. B.
Heiner, collector of internal reve-
nue for the Twenty-third Pennsyl-
vania District, against John II.
Dorman, Sidney B. Donnan, Alvan
E. Donnan and others, involving
transfers and advancements of $2,
233,333 and a federal tax of $244,
186; and that of Wallace S. handy,
internal revenue collector for the
Delaware district, against the Dela-
ware Trust Company, executors of
the will of William du Pont, in-
volving a transfer of $6,291,304
and a tax of $283,130.
In the Robert Todd Lincoln case,
in which the son of the Civil War
President, set up a trust within
two years of his death, the board
of tax appeals held the arbitrary
feature of the law unconstitutional.
Several similar findings have been
made by the board as well as by the
federal courts.
The decision does not mean that
gifts made in anticipation of death
will not be taxable. Only the sec.
tion of Section 302 (c) of the 1926
revenue act, which made the arbi-
trary ruling that all gifts made
within two years of the death of the
donor were made. in contemplation
of death, was involved in the de-
cision, internal revenue officials
said.

Moynihan's court clerk, died on
April 25.

Guthrie, of Washington, D.
C., representing 167 independen t
short-line railroads, appeared be-
fore the Senate Interstate Com-
merce Committee and informed the
members of that committee that
the life of short-line railroads is
being seriously threatened by un-
regulated motor carrier competi-
tion. Mr. Guthrie said that while
the larger roads may feel this com-
petition they do not have such
competition over 80 per cent of
their lines as do the independents.
The contention was made that
Congress had the right to regulate
contract motor carriers and that
this right is borne out in court opin-
ions.
Mr. Guthrie admitted that many
of the short-line railways operated
busses of their own but were un-
able to compete under so-called
"cut-throat" , conditions. Ile said
Congress should not permit the
country's transportation system,
highly organized, responsible in
every way, and under the juris-
diction of the Interstate Commerce ,
Commission, to be bled to death by I
unregulated, irresponsible motor
carriers, engaging in an orgy of
cut rates.
There is a bill now before the
Committee (S2793) which provides
for the regulation of motor carriers
in interstate commerce.

A ruling relative to the deducti-
bility for Federal income tax pur-
poses of a loss sustained by stock-
holders of a bank which had failed
in 1931, issued by the Internal Rev-
enue Bureau March 10, held that
