ATLANTA (AP) - Weary from a six-year legal fight over the death of their son, a Georgia couple who won a huge negligencejudgment against Gen- eral Motors Corp. - later reversed - said yesterday they were settling with the automaker. The agreement with Thomas and Elaine Moseley ofSnellville was one of four settlements disclosed yesterday in cases alleging that GM pickup trucks made from 1973 to 1989 were prone to explode. Neither GM nor Atlanta attorney Jim Butler, whose firm represented the plaintiffs in the four cases, would dis- close the terms of the settlements. Two cases in Oklahoma and one in Kansas also were settled. A Fulton County State Court jury in 1993 awarded the Moseleys $105.2 million, of which $101 million was in punitive damages. The verdict was re- versed on appeal, and was to be retried. "It's been a long time. We do have a family. We need to get on with our lives," said Mrs. Moseley, who once vowed she would never settle with GM. "It is time for the Moseleys to redi- rect their energies to the restructuring of their lives, and living rather than merely surviving," she said. Shannon Moseley, 17, was killed in 1989 when the truck he was driving - a gift from his parents - was struck by a drunken driver. The truck burst into flames, killing the teen-ager, witnesses said. GM argued that the other driver was speeding and the impact of the crash caused the explosion. Moseley was dead before the explosion, GM maintained. In a statement, GM yesterday main- tained the trucks are safe. "The cumulative safety record of these trucks readily vindicates the deci- sions of the GM engineers who de- signed them and the millions of indi- viduals who bought or drove them," the automaker said. The settlements, which must be ap- proved by the courts, were reached Fri- day after a federal judge in Oklahoma issued an order that undermined GM's defense in a trial there. GM said the order did not affect its decision to settle the cases. The judge's ruling meant that GM would have to rely solely on testimony from witnesses, without using charts or other exhibits considered crucial for a complex trial. The cases centered on GM's C/K pickups, which had the gasoline tank mounted on the side ofthe vehicle frame. Most pickups have the gas tank in the middle of the frame. About 50 other lawsuits against GM are pending over its C/K model pick- ups. GM has defended the safety of the trucks, of which about 4 million still are in use. The federal Transportation Depart- ment last year said the pickups con- tained a safety defect, though that find- ing was voided as part of a settlement between GM and the government in March. "It got to be a political hot potato," Mrs. Moseley said. The Georgia Court of Appeals re- versed the Moseley verdict, saying Butler made improper references to other cases involving the pickups. In one of the Oklahoma cases, U.S. District Judge Michael Burrage last week disallowed GM's exhibits as pun- ishment for disobeying court orders re- garding pretrial evidence. Los Angeles Times MEXICO CITY - The Mexican government and rebel negotiators took a critical first step yesterday toward settling the simmering conflict in the state of Chiapas, signing their first for- mal agreement since the two sides sat down together in April. The accord, announced early yester- day after an all-night session in the town of San Andres Larrainzar in Chiapas, appeared to do little more than formalize the agenda and procedures for more substantive talks that will be- gin next month, when negotiators vow to address the root causes of the peas- ant-backed rebellion. But both sides gave up majorground in the agreement, which analysts said sends new signals that President Ernesto Zedillo's negotiating team and the rebel commanders representing the Zapatista National Liberation Army arepreparedto compromise to end the 20-month armed rebellion-one that has fueled Mexico's current political and economic crises. In a speech soon after the accord was signed at about 3 a.m., Chiapas' Roman Catholic Bishop Samuel Ruiz, a rebel sympathizer, called it "his- toric." He spoke of"real commitments" on both sides of the negotiating table to rid the impoverished southern state of the discrimination and government abuse the Zapatistas say lies behind their revolt, which began on Jan. 1, 1994, with a shooting war that killed at least 145 people. The agreement - the first positive news from the southern state since the Zapatistas staged a daylong uprising last December that helped trigger one of Mexico's worst economic crises--had no immediate effect on the country's stabilizing financial markets. In a joint statement issued just before dawn, the two sides declared that yesterday's accord "marks the start of a new phase in the process ofbuilding ajust and dignified peace by moving on to the problems that gave rise to the conflict."
