MICHIGAN DAILY CLASSIFIED ADVERTISING RATES Study and adoption of uniform rules of evidence should be under- taken by the federal courts, Prof. Charles W. Joiner of the law school said yesterday. Addressing the opening session of the 18th annual conference for federal judges of the Sixth Judicial Circuit, Prof. Joiner calls present rules governing admission of evi- dence in civil cases "a hodge- podge." In civil cases, he observed, there is no uniformity among the federal courts concerning admissibility of evidence because of the need to apply appropriate rules in various states. Lack of Uniform Rules At the same time, federal courts do not conform to state practice in either criminal or civil cases, be- cause federal rules or statutes gov- ern admissibility of evidence in both types of cases. Lack of uniform rules of evi- dence creates inequities among lit- igants and makes it difficult for judges to apply the present stan- dards in this field. Prof. Joiner asserted. Urges Recommendations Prof. Joiner indicated authority to make the needed changes is contained in the present rule-mak- ing powers of the Supreme Court. "Only privileges, burden of proof and conclusive presumptions may involve more or should be classified as substance, and thus may be beyond the rule-making power." In conclusion, Prof. Joiner sug- gested the conference should urge the Supreme Court to create a special advisory committee to study and recommend uniform rules of evidence for the federal courts, and solicit the support of other federal judicial conferences and the U.S. Attorney General in this project.
