P.)- Charles "Chic" Harley, learding athlete at Ohio State University a few years ago, announced to his attorney today'I that he will return to Columbus next week to fight the lunacy charge miade against him two years ago. The case will be heard Monday be- fore probate judge Homer Bostwick,I who entered the lunacy finding whicht still stands. James M. Trainor, counsel for Harley, said that the famous foot-. ballplayer has filed an affidavit which Judge Bostwick setting forth that he was never examined by physicians at a lunacy hearing nor was he- ever present at such 'a proceeding. P.) -Columbus friends of Charles "Chic" Harley whose running and passing won him an immortal place in football halls .of fame while he was a member, of Ohio State's 'Western ConferenceI j team 'of 1916, 177 19, are looking for-' (ward with interest to the opening of r hearing Monday before probate judge Bostwick in which Harley will at- tempt to have set aside proceedings declaring him insane. 'Probate court records show that Harley was sent to the Dayton state hospital December 2, 1922. The lunacy affidavit was signedI by Ned Giesy, student at Ohio State university at the time. J. J. Trainor, Harley's attorney, to- day brought names into the story that are as well known in western con- 'ference circles as that of Harley when ihe was in the height of his glory. i Frank "Tee" Young, captain of this year's Buckeye squad, Trainor assert- ed, was present in Harley's room the night of December 2, when the latter, according to his attorney, was taken against his will by a deputy hsere to the Dayton institution. Young, however, today, asserted that there were no deputies in Harley's 1raoorm that night.
