"The code is inherently teetering on an edge of a right that students have not only earned but that they have also pur- chased - an education," said Flint Wainess, the president of the Michigan Student Assembly, during public com- ments. During the meeting, many regents spoke against any form of a speech code, raising concerns about the constitution- ality of the proposed code. "Significant evidence indicates that there are some serious issues raised that might not stand up on their own in court," said Regent Deane Baker (R-Ann Arbor). "Because we're controlling con- duct, we're also controlling speech." Hartford assured the board that First Amendment rights would remain pro- tected. "Any document we would write would carry in it a passionate defense of a student's First Amendment right," she said. After commending the recent student interest, the regents encouraged Hartford to collect student input on the code over the summer. "There will be a code," said Regent Philip Power (D-Ann Arbor).
