Wednesday, May 17, 1995 - The Michigan Daily -9 'U' denies appeal in harassment case By Ronnie Glassberg Daily Editor In Chief The University has denied an appeal under the Statement of Student Rights and Responsibilities by American culture doctoral student Melanie Welch, who was found responsible in January of ha- rassing a neighbor. Welch's case was the first open hear- ing under the University's code of non- academic conduct. David Cahill, the attorney who ad- vised Welch,criticizedthe three-member appeals board for its decision. "Ihaven't any idea what they did, which is a due process problemin itself,"he said. Mary Lou Antieau, judicial adviser for the code, said the appeals board had a significant discussion before reaching its decision. "Imet with them at the beginning of their meeting and advised them that they had the responsibility to deal with the ap- peal, and there were no specific questions," she said. The code provides for no further ap- peals beyond the board. Welch said she would like pursue the matter in the courts, but does not have the money to continue the case. The local chapter ofthe American Civil Liberties Union had referred Welch's case to the state ACLU. An official with the state ACLU said yesterday that they had decided not to take Welch's case. Under the Michigan Freedom of Infor- mation Act, Cahill requested copies of all materials the appeals board used inconsid- ering Welch's case, excluding the official hearing file, which they already received. The University granted the request and pto- vided aone-page letter from the board. "They didn't do their job. They were supposed to analyze the errors that were made in the hearing, and they didn't do it," Welch said.
