Duderstadt refused to comment on
the Phinney case.
"I cannot comment on pending liti-
gation," he said in a recent interview.
The University is currently trying to
get Phinney's million dollar jury ver-
dict thrown out of court.
Duderstadt said it was OIG's duty
toreport directly to him on misconduct
cases, but said OIG has not been in-
volved in an investigation of the Uni-
versity.
"If the inspector general is investi-
gating theUniversity,I would be forced
to step aside,"he said. "Butthis has not
happened."

matters involving grants and audits
and that it is NSB's role to serve only
as a policy-making entity.
Fischer said Duderstadt would
wield considerable control in an OIG
investigation.
"Itis the chair (of theNSB)whohas
more of a direct oversight over inves-
tigations more than any individual
would," Fischer said.
In a January speech before a local
scientificorganization, Duderstadtad-
dressedtheevolutionofscientific-mis-
conduct investigations.
"We arenow comingtounderstand
and accept that we have to make (the
University's) code clear and enforce
it," he said in the speech. "Or others
will do it for us."
He added that the University must
re-evaluate its fraud policy and that
policies and procedures must change
in order to address new challenges.
