UNDER SECTION 5.09 guidelines, SACUA is not obligated to hear the ap- peal, but agreed to, Hildebrandt said, because this is the first time that the Committee on Tenure has heard a dismissal case. "We are trying very, very hard to be fair," said Hildebrandt. "This is the fir- st time in University history that this procedure (Section 5.09) has been used, so we are going about it very carefully." If SACUA concludes that the hearings were not conducted fairly, the case will be heard again by the tenure commit- tee. BUT IF SACUA finds the hearings were carried out properly, the commit- tee's recommendations will be sent to University President Harold Shapiro. Under Section 5.09, Shapiro may con- sult with SACUA, the vice president for academic affairs and the LSA ad- ministration before sending his own recommendations on the case to the Regents for final action. Hildebrandt said he would not discuss the charges in the case. "At this point, any disclosure might influence the final outcome," he said. "SACUA will meet as soon as possible." In another sexual harassment case this year a review board in the Rackham School of Graduate Studies took action against a Medical School professor who harassed a graduate student.
