Shoplifting charges against Smith dropped EAST LANSING (UPI)- Shoplifting charges against former Michigan State basketball star Kevin Smith were drop- ped yesterday because the prosecution was unable to produce key witnesses, a defense attorney said. "This is a great day for Kevin-now the cloud is removed from over his head and he can continue with negotiations with professional teams for his ser- vices," said the attorney, Hugh B. Clarke, Jr. SMITH SAID he was "relieved." No mention was made of separate charges accusing the 23-year-old Smith of driving on a suspended license. Smith, named MSU's most valuable player last year in his senior year, was accused of stealing two bottles of wine from an East Lansing convenience store in February, 1981. THE TRIAL date on the charge, however, was delayed until April 5 of this year-well after the end of the 1981- 82 basketball season. When the standout guard failed to show up for the trial, however, a bench warrant was issued against him. He was excused by East Lansing District Judge Donald Tschirhart when he showed up in court with his attorney one day after news stories about the in- cident broke. CLARKE SAID at the time Smith never received notice of his trial date and was out of town, thinking the trial later in the month. He said Smith was tied up during the period before April 5 with various basketball camps across the state. Clarke, in discussing the latest development in the case, said in ad- dition to the failure of prosecution wit- nesses to show, there was conflicting evidence from others which "would lead a jury to believe Smith was in- nocent."
