Werker conducted' two days of' hearings on the matter in Rochester, N.Y., last week and his decision is ex- pected later this week. STILL ON the negotiating table is a proposal by the Players Association which would create a pool of players to supply compensation for teams losing quality free agents in the re-entry draft. Marvin Miller, executive director of the union, said management had not in- dicated any inclination toward accep- ting the offer. "If they've changed their minds, it was not noticeable in terms of the comments we got," said Miller. "We indicated Saturday that we had reasonable flexibility on a whole raft of points and we're certainly open to suggestions, counter-proposals or whatever. They made none." MILLER SAID most of the time yesterday was spent with the two negotiating teams meeting amongst themselves. "We spent perhaps 15 or 20 minutes, at most, together," the union chief said. Ray Grebey, director of management's Player Relations Com- mittee, said no progress had been made yesterday and refused further com- ment.. Another meeting was tentatively scheduled for 3 p.m. today. The timing depends on whether Werker's decision is announced earlier in the day. Miller said he would want to consult with the player representatives after that decision. If Werker issues the injunction, it would rescind for one year management's compensation program and delay any possible strike by the players. If the judge withholds the in- junction, the players have said they would go on strike within 48 hours of that decision. Nets obtain Birdsong By The Associated Press The New Jersey Nets obtained guard Otis Birdsong, the National Basketball Association's sixth-leading scorer last season at 24.6 points per game, from the Kansas City Kings yesterday in ex- change for forward Cliff Robinson. The deal, which came after Kansas City matched the free agent "offer sheet" Birdsong had signed with Cleveland, was reported by the New York Post and confirmed by Nets General Manager Bob MacKinnon to The Associated Press. BIRDSONG, WHO became a free agent this summer, agreed to a five- year contract with Cleveland calling for a base salary escalating from $800,000 to $925,000 per year. The contract also contains an attendance bonus clause by which he will receive 50 cents for every ticket sold beyond 5,000 per game. Under the NBA's right of first refusal system, the Kings had 15 days in which to match Cleveland's offer or else lose Birdsong without compensation. Rather than be left with nothing, the Kings matched the offer and then dealt him to the Nets. As part of the deal, the Nets will also receive a second-round choice in today's college draft from the kings. English'status unsure DENVER (AP) - - The Denver Nuggets announced yesterday that a National Basketball Association ar- bitrator has delayed ruling on a repor- ted $3.5 million offer for free agent forward Alex English by the Seattle SuperSonics. The arbitrator ruled that English and the Super Sonics should have had their offer evaluated by an arbitrator before they submitted it to the Nuggets, the Denver club reported. THE NUGGETS were to have made a decision by June 15 on whether to try to match the offer and keep English, mat- ch the offer and trade him to another team, or let him go to Seattle with no compensation. English came to the Nuggets last season. The Nuggets said that the arbitrator did not expect to evaluate Seattle's of- fer and issue a decision on it until June 17 at the earliest. The Nuggets will have 18 days after the evaluation is complete to decide what to do with English. The SuperSonics reportedly have of- fered English a five-year contract at $700,000 a year. 'E' back to Houston HOUSTON (AP) - The Houston Rockets traded two draft choices to reacquire 12-time National Basketball Association All-Star Center Elvin Hayes from the Washington Bullets, team officials announced last night. HOUSTON GAVE away its second round choice in today's NBA draft and its second round choice in 1983 to get back the former University of Houston star the Rockets sent to Washington in 1972 in exchange for Jack Marin, said team spokesman Jim Foley. Hayes, 35, is the sixth all-time leading scorer in the NBA with a career total of 24,547 points and is third in career rebounds with 14,656. The 13-year NBA veteran, who began his career with San Diego and spent one season in Houston when the franchise moved to Texas, averaged 17.8 points a game last season - the worst average of his career.
