THE UNNVERSITY contends the Standard Practice Guide-a set of policies that explain and interpret the Regents' bylaws-was followed in the committee's decision not to reappoint Marwil or grant him a tenure review. Ross, who was Marwi 's first witness following his own direct testimony this week; said Loomis made his comment about the ad hoc committee some time after a meeting of the department's senior faculty in April, 1978. Mathes convened that meeting to poll the faculty members present on the question of Marwil's reappointment. The administrative committee sub- sequently disregarded the faculty vote to give Marwil what Ross said he inter- preted as a tenure review. UNIVERSITY ATTORNEY Robert Vercruysse, in his cross-examination of Ross, attempted to establish that Ross' memory of the events and decisons at the meeting was faulty. In earlier testimony yesterday, Mar- wil appeared to contradict a statement he made Wednesday regarding the alleged violation of his rights. Under re-direct examination by his attorney, Jerold Lax, Marwil.repeated his belief that a consideration of possible contract termination in 1978-falling as it did in his fifth year at the University and in the middle of a two-year contract-violated depar- tmental and College guidelines. He said what he should have received was a tenure review in his sixth year rather than a reappointment review in his fif- th. ALTHOUGH WEDNESDAY Marwil said a fifth-year review by an ad hoc departmental committee-rather than the administrative committee review that he actually received-would have satisfied his rights, yesterday he said such a review would not have upheld his rights. When questioned on this contradic- tion by Vercruysse, Marwil conceded that he would stand by his original testimony, but added that testimony was given only after "a long moment to think." Vercruysse indicated that Marwil's original testimony-which seems to undermine his contention that no review of any type should have been performed in 1978-might have been damaging to Marwil's case. VERCRUYSSE ALSO attempted to demonstrate that the reappointment review conducted in 1978 was nearly equivalent to a tenure review. Ulrich's: The Source.
