However, Hemphill argued that all the amend- ment aims to do is to protect the traditional mean- ing of marriage. "This has never been about taking benefits away from people. The last six words of the amendment were added on the advice of our legal counsel in order to precisely define marriage. Even the court of appeals agreed that this was the best way to protect the definition of marriage." "With Proposal 2, the goals of the ballot were very intentionally left out, unlike other proposals," Knittel countered. "The proponents do not want people to know how broad the amendment is, and what it will actually do." University Law School Dean Evan Caminker said, "There is sufficient passion on both sides to bring this case to the courts in order to define exact- ly what the amendment means." A possible position opponents could take is to challenge the constitutionality of the amendment based on the way it is worded. Mae Kuykendall, professor of law at Michigan State University's Col- lege of Law, explained, "The wording of the amend- ment is a poor match for what its proponents claim it should achieve - that is, to protect marriage from an assault by state judges. This amendment goes much farther, appearing to invalidate private arrangements and civil unions." She noted that state laws already ban gay marriage and that Michigan's conservative courts currently would not use the state constitution to overturn the statutory ban on gay marriage. Hence, according to Kuykendall, the wording of this amendment is hos- tile to homosexual people as it denies them benefits that domestic partnerships and civil unions offer. While unmarried heterosexual couples will suf-. fer a similar loss of benefits that normally come with civil unions - because the amendment says that the state can only recognize marriage as a type of legal union -gay couples will bear the brunt of the proposal, she added. Despite the proposal's outcome, the University said it will still offer benefits to same-sex and het- erosexual couples. President Mary Sue Coleman has said the University will continue offering health care and other benefits to same-sex domestic part- ners of University employees. In a letter to Univer- sity faculty and staff on Oct. 14, Coleman wrote, the University will "vigorously defend (its) right to offer such benefits," regardless of the amendment. Knittel applauded Coleman's stand. "It is a good place for the University to be standing up for what it believes in - equality."Washtenaw County was among those that voted against the proposal - about 65 percent voted against it. As of 4:40 a.m. today, 10 out of the 11 states, that put gay marriage bans on the ballot had approved their proposals. ELECTION Continued from page 1 bled in Boston's Copley Square. At the Bush camp in Washington, the cam- paign claimed it had secured 269 electoral votes but was able to confirm no more states voting to reelect Bush. News agencies called just 249 electoral votes for Bush. The crowd at the pres- ident's victory party, who had been expecting the president to address the crowd after receiv- ing 270 votes, soon realized that the election may go uncalled. The segment was received by silence as most guests looked around confused. Following was an explanation that the Kerry- Edwards campaign did not accept any sup- posed Bush win in Ohio, and that New Mexico and Iowa were too early to call. Prior, a number of Republicans addressed the crowd, some alluding to the fact that either Vice President Dick Cheney or President George Bush would be addressing the crowd. Bush's former press secretary, Karen Hughes, rallied the audience by thanking all the support- ers for their hard work and also announcing a Bush victory in Florida. "The prosperity of our country is on the line in the election," she said. "I think we'll have some very good news tonight." The resolution to the dilemma over votes could take days. The Kerry campaign believes unread provisional ballots in Ohio may close the gap between the Democratic nominee and President Bush in the state. The campaign contends that the number of provisional ballots in the state exceeds the margin between Bush and Kerry in the state, making it numerically possible for the Massachusetts senator to overtake Bush in Ohio and claim the state's 20 electoral votes. Under Ohio law, election officials can begin to verify the authenticity of provisional ballots today but cannot begin tallying the votes until Nov. 13. While watching election results on a large screen, Bush supporters paid the most atten- tion to Florida and Ohio, the two most con- tested states in the election, screaming louder each time the president made a small advance in either state. Party guests were overjoyed and the room erupted with applause when it was largely conceded that Florida would go to the president. But the cheers were deafening when Brit Hume of FOX News announced at about 12:45 a.m. that Ohio had gone to Bush. Republican cheers grew louder through the night with each state that received more votes for the president, shouting especially hard at announcements showing Republican candi- dates advancing in Senate races and ultimately maintaining its majority over Democrats. The Senate race in South Dakota riled up most of the party guests when the GOP candi- date John Thune vanquished Tom Daschle, the minority leader of the Senate. The victory of David Vitter, the Republican candidate running for Senator of Louisiana, also elicited a loud response. Republicans began gathering in the Reagan Building in the early evening yesterday and were rewarded for staying up until the early morning hours with what many claimed was a win for their candidate as well as an appearance by the president. These party guests mostly ignored the media. Officials working at registration said this was because they were there to enjoy themselves and not to talk to reporters.
