"This plan will be another manage- ment tool to ensure an adequate applicant pool." Steiner added that if the city finds any department does not represent the demographic make-up of the available workforce, the city will have the ability to reprimand and make amends in that particular depart- ment. The Michigan Department of Consumer and Indus- try Services stipulates that any federal contractor, such as the city of Ann Arbor, receiving $50,000 or more in federal funds, needs to have a plan in place ensuring equality and diversity, said Steiner. City Attorney Abigail Elias said the new policy will comply with federal regulations. "The best way to increase diversity in the workplace is to increase diver- sity in applicants," she said. "If all goes well, those hired should reflect the workforce they are gathered from."' Elias assured that the city already strives to promote diversity and fairness in its hiring procedures, but the new policy would clarify and set necessary stipula- tions. "The current department is good in ensuring appropriate employment practices - the document may lay it out more clearly," she said. Elias said one of the reasons the affirmative action plan has taken so long is due to revised state regula- tions in November and language issues. The human resources office hopes to submit the plan at the first council meeting in May, and Elias said she sees no rea- son the policy would not pass. After passing a resolution last June supporting affir- mative action at the University, several city officials said they were disappointed with U.S. District Judge Bernard Friedman's ruling last week that the Law Schools use of affirmative action was unconstitutional. Councilwoman Heidi Herrell (D-Ward III) said the decision against the University upset her. "I believe in affirmative action and feel it is very necessary to right past injuries," Herrell said. "It is very important that those who come from homogenous towns learn diver- sity first-hand at a University." Herrell added that she is impressed the University utilized so much effort in the courts and said diversity is an issue that the city and University see eye to eye on. "Ann Arbor and the University have a tradition of being very forward-thinking. People will be glad that the University tried to do the right thing," she said. "They will think it is very typical of Ann Arbor." Councilwoman Jean Carlburg (D-Ward I1) said affirmative action is necessary to ensure the quality of education that the University stands for. "I am greatly disappointed at this ruling that will not allow the diversity necessary to create good lawyers," she said. "This is a setback to the Law School, the stu- dents and the community." Carlburg said the lawsuit did not take into consider- ation the diversity that is coveted by the city of Ann Arbor.
