House Speaker Chuck Perricone (R-Kalamazoo Township), said the legislation would close a loophole that allowed Detroit teachers to strike for nine days at the beginning of this school year without facing the fine of a day's pay for each day of the strike. "There are a number of school districts that have not yet signed onto contracts this year" he said. "We really feel we don't want to have another strike' Inder the school strike ban passed in 1994, teachers can be teed after school administrators report the strike to the Michigan Employment Relations Commission, which the Detroit district chose not to do. Perricone said the ouse bill would allo w MERC to fine teachers even if school administrators fail to report the strike. It also would allow any school district resident or parent to file a complaitt requesting the fines after the first day of a strike. "Detroit Public Schools chief David Adamany told the House Employment Relations Commitee yesterday momning that enforcing the 1994 ban on teacher strikes is too costly for a Qe district since a complaint has to be filed against eveiy teacher "There would be, more than 8,0001 hear ings. The irtIng of lawyers for that swould be svey expensive" hi' said. Perricone said the bill would allow forconsolidated hearings, which would lower the cost. But Adamany expressed concern that such hearings would violate teachers' right to due process. "Maybe swe should be looking at other remedies to teacher strike Adamany said. "One of those could be a time limit, and then you could get an injunction" ending the sthike. ,Rep. Paul DeWeese, sponsor of the legislation, said the most V ittant issue is enforcing the ban on teacher strikes.
