The Michigan Daily - Thursday, March 9, 2000 - 7A Deliberations continue in HB murder trial DETROIT (AP) - A second day of jury deliberations produced no verdict yesterday in the involuntary manslaughter and poisoning trial of a man accused of slipping the so-called date rape drug to a 15-year-old girl. Meanwhile, a separate jury began hearing closing arguments in the trials of three other men who were with Joshua Cole the night that Samantha Reid of Rockwood died and her friend Melanie Sindone was sickened by GHB. GHB, or gamma hydroxybutyrate, has been linked to at least 58 deaths since 1990 and more than 5,700 recorded overdoses, accord- ing to the Drug Enforcement Administration. There have been at least four GHB-related deaths in Michigan in addition to Samantha's. Samantha was taken off life support Jan. 17, 1999, a day after she and two other girls ingested GHB at a party. The third girl was not sickened. A few drops of the colorless and odorless drug can be slipped into a drink, rendering a victim unconscious within 20 minutes. Victims frequently have no memory of what happened, and the drug is difficult to trace, often leaving the body within 24 hours. President Clinton last month signed legisla- tion toughening federal laws against possess- ing, making or distributing GHB. The bill is named for Samantha and a Texas teenager who also died after GHB was slipped into her soft drink. Prosecutors have "tried to make this trial about GHB," Brian Dailey, attorney for Nicholas Holtschlag, said yesterday in his clos- ing argument. But Dailey said authorities found no evidence that either girl was sexually assaulted after ingesting GHB, and the sub- stance is so new that the medical community disagrees on what amounts to a lethal dose. Wayne County assistant prosecutor Doug Baker reminded the jury of testimony from Melanie, now 16, who told investigators that one of the men checked the unconscious Samantha's pulse before she herself passed out. "It's known (by the suspects) that there's some possibility of real illness here," Baker said. He said the case was about manipulation. "Once they got them in that condition, they rolled the dice with their well-being. ... how selfish these actions are, and how cowardly, on the part of these defendants," Baker said. A separate Wayne County Circuit Court jury heard the case against the 19-year-old Cole because he allegedly confessed. Like Cole, Holtschlag and Daniel Brayman, both 18, are charged with involuntary manslaughter, punishable by up to 15 years in prison, and two counts of felony poisoning, which carries a possible life sentence. Last week, Circuit Judge Maggie Drake threw out a felony poisoning charge and the manslaughter charge against the fourth defen- dant, Erick Limmer, 26, whose Grosse Ile apartment was where the young people had gone to drink, smoke marijuana and watch tele- vision. Limmer still faces one charge each of poi- soning, delivery of marijuana and possession of GHB. The Michigan Supreme Court yesterday denied the prosecution's appeal of the dismissal of the manslaughter charge against Limmer. IPipe up Federal scholarships mistakenly given to 39 graduate students U.S. government may pursue legal action NEW YORK (AP) - Thirty-nine stu- dents were told last month they had won prestigious government scholarships for graduate study, only to find out later that it was all a big mistake and they were only runners-up. "I think my heart snapped in half," a California doctoral candidate wrote her congressional delegation in a plea for help. Help came yesterday when the Educa- tion Department called the runners-up and said they will get the fellowships after all, as will the rightful winners. "We were working at first to find out what happened and why an error occurred. After reviewing that, we came to the con- clusion this was the right thing to do," Education Department spokeswoman Erica Lepping said. It will cost taxpayers close to $1 million to fix the error, which the government is blaming on a private contractor that sent the wrong letters. Lepping said the mistake was discov- ered when a runner-up, officially called an "alternate," called the agency with a ques- tion. At stake were the prestigious Jacob K. Javits Fellowships, which have been awarded since 1986. Named for the late liberal Republican senator from New York, the fellowships pay tuition and fees plus a stipend for doctoral and master's candi- dates in the arts, humanities and social sci- ences Current stipends are $15,000 a year. The winners are selected on merit and financial need and get up to four years of financial support. Some 1,100 to 1,300 stu- dents apply each year. This year there were 138 winners, in addition to 39 alternates. Under privacy rules, the names of schol- arship winners are confidential. Among those who got the good news and then the bad news was the California student, who found a message on her answering machine telling her she wasn't really a winner. The way she found out "was devastat- ing" and "very flaky," said Nancy Coolidge, coordinator for government rela- tions and student financial support at the University of California system. Coolidge shared the student's e-mail but said the woman didn't want to be named. It was one of many such pleas to Congress. The government is considering legal action against the contractor, DTI Associ- ates of Arlington, Va. The company has a one-year, $190,000 contract to handle applications. Bruce Rankin, director of government services at DTI, said yesterday: "We physi- cally mailed letters that were developed by the Department of Education." Later he issued a statement saying An unfortunate miscommunicanon between both parties led to a clerical error We are actively working with the department to resolve this issue Our sincere concern is with the scholars and that is that they're treated with respect throughout this process." The 39 students had the law on their side, though Lepping said no lawsuits were threatened. An amendment to the Higher Education Act of 1992 bars the department from retracting Jas fellowships after they are awarded, unless the student lied on the application. Normally, alternates get fellowships only when winners decline the fellowship because they have gotten money elsewhere. The government estimates the mistake could cost up to $975,000, depending on how many winners take the fellowships. Terry Hartle, lobbyist for the American Council on Education in Washington, an umbrella group for higher education insti- tutions, applauded the government's move. "It shows the sort of government errors that hurt individual people," Hartle said.
