Both attorneys repeatedly denied any direct correlation between Cantor's death and the Oct. 15 party. *"The individuals I represent - their activities that night have no relationship to the death of Courtney Cantor" Addis said. "Nobody charged these kids with anything that has to do with the death of Courtney Cantor." "I don't want to get to the point where I'm defending a case we are not charged with," Simon said. "We don't know that the alcohol or drugs in her system con- tributed to her death." Addis said he will likely seek to dis- *ss some charges against the fraternity members. "I think some of the charges are unwarranted," he said, refusing to elabo- rate as to which specific charges he meant. Arraigned today were LSA sopho- mores Michael Novick, Michael Halper, Evan Frank and Josh Shapiro and Engineering junior Daniel Davis on *unts of fi.irnishing alcohol to minors dallowing minors to drink at the house. Feldheim, LSA sophomores Simeon Maleh, Jared Fishman and Jeremy Bier and Music sophomore Jordan Schmidt were arraigned on identical charges, plus an additional charge of purchasing alco- hol with fraudulent identification. "It's in the hands of the court," Logghe said. Addis said he plans to probe the case himself now that AAPD and DPS have released their final reports into Cantor's death. "Now that we have something to review, we'll do our own investigation;' Addis said. He said he suspects a connection between the AAPD raid of the former Phi Delt house last Friday and a story aired last night by the CBS newsmagazine "48 Hours" about Cantor's death. Addis took responsibility for fraternity members' refusals to cooperate with police investigations into the Oct. 15 party. "These kids were advised by me not to talk to police," he said, adding that he had also advised them to not answer any reporters' questions. Addis was careful to note that neither he nor any of his clients have admitted guilt. "As these kids leave this courtroom today, they are innocent;" Addis said. After arriving at University Hospitals shortly after the incident, members of Sigma Chi continued to use racial slurs in the presence of hospital staff, Brooks said. Jackson suffered a broken rib and punctured lung from the fight, Brooks added. A Sigma Chi representative who asked to remain anonymous said no racial slurs were used during the incident. "It was not racially provoked," the representative said Brooks said he recommended Jackson take action through the Student Code of Conduct against the fraternity members, despite his own problems with the Code system. "What are we going to do? You have to fight fire with fire legally," Brooks said. Brooks was disciplined under the Code last February for sexually assault- ing a female Kinesiology student. "Coach Carr told me it was time for this to come out;' Brooks said about his decision to break months of silence on the Code case. He added that Carr and his teammates have been supportive throughout both incidents. Brooks said the case, which after near- ly a year is still open, needs to come to a close. During Code cases, the accused student is allowed to select mediation or a hearing. Brooks selected mediation with former Assistant to the Vice President for Student Affairs Mary Lou Antieau. Brooks said Antieau told him even if he was found not guilty in Washtenaw County Court, he could still be prosecut- ed under the Code. Antieau said the University would push for expulsion, Brooks said. But, Brooks said, Antieau told him if he agreed to plead guilty in court, no double jeopardy would be imposed on him, but Brooks would be restricted from entering the residence halls except for meals and be required to attend a sex offenders workshop. As a result, Brooks changed his plea to "guilty" and was restricted from contact with the victim, required to received counseling and recieved a four-game suspension Brooks was found guilty of criminal sexual conduct in a Saline court in June and was placed on probation under the Holmes Youthful Trainee Act. Following the court's ruling, Brooks said the victim sent an e-mail to a group stating that "the court didn't punish him enough" and that a conspiracy had led to Brook's punishment as prohibition. In July, Brooks said he expected to fin- ished the Code case, but was told by Antieau that "things have changed." Brooks said Antieu told him the victim asked for Brooks'removal from the team. "I already went to court and changed my plea ... and accepted my responsibil- ity," Brooks said. Shortly after the ruling, Brooks moved to off-campus housing. "From my understanding the suspen- sion was it. After that I was clear to go," Brooks said. He said he signed a resolu- tion outcome document. After the victim, who could not be reached for comment last night, told details of the Code case to The Michigan Daily in September, Brooks said his right to privacy under the Code was violated. This prompted him to file a Code com- plaint against the victim for allegedly violating his privacy. "I filed a Code complaint against her and nothing happened," Brooks said. The University wants to first finish the case against him before examining his com- plaints, Brooks said. I Several months into the case, Antieau retired from the University, much to Brooks' surprise. "She's in the middle of my case ... and the next thing you know, it's her retire- ment party," Brooks said. Brooks then began mediation -with Assistant to the Vice President for Student Affairs Sean Esteban McCabe. "I sign off again on a document saying these are the sanctions and I accept these responsibilities," Brooks said. Brooks said he assumed the Code case was closed, but a few weeks later the vic- tim appealed the ruling. The University "said they had to start the whole case over," because proper pro- cedures were not followed, Brooks said. "I've already served the punishment ... and they start the whole thing over." Brooks said his lawyers are now wait- ing to hold a meeting with the University General Counsel to end the case against him by arguing the arrangements made with Antieau, the handling of the case by the University and Brooks' invasion of privacy warrant its conclusion. Brooks said the victim now wants to sue him in civil court. "It's not like this was some phantom deal," Brooks said. Brooks said most of his problems at the University stemmed from a problem with alcohol that he has addressed. "I've made a lot of poor decisions here," Brooks said "I just want the truth to be known. "I'm not trying to attack (the victim) at all," Brooks said. "Under the illusion of alcohol that night (I thought) she was OK with the advances I made." "I asked her and she never said Rio," Brooks added. Director of Athletic Media Relations Bruce Madej said last night he had heard Brooks may be suspended under the Code.
