Simpson jury looking on, a prosecution criminalist made a startling claim yesterday that he tossed a vial of Simpson's blood into a plas- tic bag and left it unguarded on a lab table overnight. "You put Mr. Simpson's blood on a table, unrefrigerated?" defense at- torney Barry Scheck exclaimed in a tone of disbelief. Criminalist Dennis Fung, enduring his fifth day of brutal cross-examina- tion, said he placed all evidence gath- ered from Simpson's estate on an evi- dence table in the police laboratory the night of June 13 and went home. The next morning, he said, "I did not detect any of my evidence from the night before being disturbed." Fung's statement came late in a day dominated by the explosive de- tails spilling out about turmoil among certain jurors, over matters as seem- ingly trivial as phone privileges and as serious as racial disrespect. Defense attorney Johnnie Cochran Jr. said reports of kicking and hitting among the sequestered jurors could be sufficient to result in dismissal of at least one more panelist. He was likely referring to juror 353, a white woman mentioned repeatedly in the account of unhappy sequestration provided by a Black woman dismissed from the panel last week. The 12 jurors and six remaining alternates, presumably unaware their dirty linen is being aired in public, listened intently as Scheck again went to work on Fung about how Simpson's blood was handled. Fung appeared rattled at times, taking long pauses before answers and often claiming a faulty memory. He markedly changed his testimony after viewing a defense videotape, claiming for the first time that it was his assistant who carried an envelope containing the blood vial out of Simpson's home, inside a black trash bag. Earlier, he testified he carried the blood out to his truck. "When you got back to the pro- cessing room did either of you take the envelope out of the black plastic bag?" Scheck pressed. "No," Fung said. "Mr. Fung, none of this ever hap- pened as far as putting this gray enve- lope in a black plastic bag, isn't that correct?" Scheck asked accusingly.
