At the University, the audit's stated purpose was to determine if all tax- able income was reported on the University's tax returns and if only ordinary and necessary expenses were deducted during the three fiscal years of 1989-91. "They looked at everything the University does from top to bottom," Harrison said. "In early 1994, we be- gan a series of negotiations that lasted eight months where we tried to nego- tiate what should be paid and what should not." Harrison said these meetings with the IRS agents were unproductive and the University requested a "notice of deficiency" from the IRS. "We can't initiate action in the tax court. They have to initiate action against us," he said. On Dec. 22, the University re- ceived the IRS notice and had 90 days from that date to file a petition in the U.S. Tax Court. In the notice, the IRS said it in- creased the amount of unrelated busi- ness income because "the University did not properly account for all tax- able income due to: improperly esti- mating income, not including income from persons who did not meet the convenience exception found in (the tax code) and not including income from activities not substantially re- lated to the University's exempt pur- pose. In one area, the IRS says the Uni- versity underreported income from "major campus events" by $2,941,522 over the three years and reported in- appropriate deductions of $3,221,291. The University claims that these revenues did not constitute an unre- lated trade or business gross income. "(The Major Events Office) did not select an event for a program season with the primary intent of earn- ing a profit on the particular event. Instead the decision was based'prima- rily upon whether the event was con- sistent with the MEO's mission," the University attorneys wrote in the pe- tition.
