Simpson's estate at 10:22 p.m. on June 12, 1994 - either in the drive- way or on the street, the driver told jurors yesterday. The precise time, recalled by a man whosejobperformancedepended on his wristwatch, helped frame the period in which prosecutors say Simpson drove two miles to his ex- wife's home, killed her and a friend, returned to his estate, where he dropped a glove, and cleaned up in time for his scheduled limousine ride to the airport. With time and motive as key is- sues, the prosecution also disclosed it has a cellular phone record indicating Simpson called the home of his ex- wife, Nicole Brown Simpson, the af- ternoon of June 12, before their daughter's dance recital. "We have a witness who observed him on the cell phone angry, yelling," Deputy District Attorney Marcia Clark told the judge and defense at- torneys Monday outside the jury's presence. A transcript of the bench conference was released yesterday. The phone call was mentioned for the first time Monday during the tes- timony of former Simpson houseguest Brian "Kato" Kaelin, who left the stand yesterday after five days of tense prosecution questioning. In his testimony, Kaelin said Simpson never mentioned a phone conversation with his ex-wife the afternoon before the murders. Pros- ecutors indicated the call, which lasted four minutes, was made at 2:18 p.m. from the Riviera Country Club, where Simpson played golf and gin rummy with several buddies. Clark indicated that a woman at the country club who saw an angry Simpson talking on the phone would be called to testify. HOUSTON (AP) - A state dis- trict judge decided yesterday to dis- miss Dow Chemical Co. from a $5.2 million breast implant verdict, scor- ing a critical victory for the half- owner of Dow Corning Corp. In a one-page letter to lawyers, Judge Michael Schneider said he has "disregarded" jurors' Feb. 15 finding that Dow Chemical gave Dow Corn- ing "substantial encouragement or assistance" in marketing the implants using inadequately tested materials. Following a 10-week trial, Dow Chemical only had been found liable on that one issue of five the jury had to consider. "I think it vindicates the position that my client took which was that Dow Chemical was not a proper party in the silicone implant litigation," said Richard Josephson, attorney for Dow Chemical. The initial verdict has been trou- bling to both sides because on one hand, jurors found no negligence or implant defect, but on the other, they found Dow Chemical should be made liable because it provided assistance in marketing a product that Dow Corn- ing did not adequately test. Schneider's decision now under- cuts the hairline triumph trumpeted by plaintiffs lawyers last month when ju- rors found Dow Chemical liable for the first time in breast implant litigation. Dow Corning will now bear the entire amount of the verdict won by retired Bellville nurse Gladys Laas and her husband. "This confirms what we have been saying all along - that Dow Chemical did nothing wrong and caused no harm to the plaintiffs," said John Scriven, general counsel for Dow Chemical. "There is no basis upon which to hold us in the breast implant litigation."
