RECYCLE It I ~19 O*- Mo MITCHELL Continued from page 1 - to be 8-12 hours before he arrived at the crime scene around 1:30 a.m. on May 8. Lankford questioned the method in which the DNA evidence was gath- ered and who had access to the samples during the investigation. The defense also hypothesized on alternative causes of death, including injuries sustained during a 1987 traffic acci- dent Gailbreath was involved in. The defense also challenged the medical examiner's prior experience in col- lecting DNA evidence for possible sexual assault cases. The second rape victim testified as to the details of her assault. The woman said she typically took morn- ing walks along trails in Eberwhite Woods, where she was raped on Sept. 28, 1992. Her husband testified that when she had not returned from her walk, he went looking for her and ran into a jogger, who he asked to be on the lookout for his wife. The jogger later notified the man and the police that she had found his wife in the woods. "I could see that she was in a fetal position lying on the ground," the jogger testified. "It was clear to me something was wrong. She didn't say anything but groaned. "She had no pants or underpants," she testified. "When I got to her, I screamed, 'She's been raped!' (Herhead) was covered with blood. I was very disturbed by what I saw. I freaked out." Jorge Rodriguez, the University Hospitals physician who treated the second victim when she was admit- ted, testified that "there was abra- sions near the vagina and some scrapes near the thighs. She had multiple loose teeth (due to being struck in the face)." The woman testified it had been at least a week before she was raped that she last had intercourse. The victim said she does not recall the events between when she was admitted and lost consciousness at the hospital and awoke four days later. The third rape victim testified she was returning by cab from buying cups and vodka, some of which she drank, when she lost consciousness as she put the key in her apartment lock. She said she woke up to find a masked man of undetermined race with broad shoulders raping her in her living room. Under defense question- ing, she said Mitchell's shoulders met her definition of "broad." She said she blacked out and was awakened by the sound of her friend ringing the doorbell at9a.m. laterthat morning. The friend soon called an ambulance that took the victim to University Hospitals where DNA evi- dence was collected. The woman was asked by Lankford if her videocassette recorder - an item police were looking for when they searched Mitchell's resi- dences- was missing from her apart- ment. She could not positively say when she first noticed it was missing, but she testified it might have been stolen following the rape. When cross-examined by Mitchell's attorney, the second and the third rape victims provided little details as to the description of the assailant. The examination will continue today beginning 9 a.m. with expected testimony from the other rape victims and more expert witnesses including Ann Arbor police officers and medi- cal personnel. 3RD ROOMMATE NEEDED - Call 764- 8610.
