This is pure speech," Cahill said. "We said we want the suspension lifted." The decision from Friday's hearing is scheduled to be made today. "If the result is not satisfactory we have the right to a formal hearing," Cahill said. DPS Capt. Jim Smiley said the mat- ter is under investigation by the Uni- versity police. "I think it's a safety issue. We were concerned," Smiley said. "We're still investigating. We haven't drawn any conclusion yet." Cahill said the University's sus- pension of Baker was inappropriate. "There is no rule forbidding anyone fromjust being disgusting," Cahill said. "What they've done is taken action against someone without a rule at all." Besides the University, the FBI also is looking into the possibility of charg- ing Baker with the distribution of obscene material under the federal obscenity statute, according to pub- lished reports. University administrators involved in the case referred calls to spokes- woman Lisa Baker. "This person is not a student and if they were a student I would not be able to comment because of (the Family Education Rights and Privacy Act), which protects student records," she said. Velma Baker said she was shocked "People are realizing that the Re- publicans are carrying out their prom- ises, and they are making an impact on the voters," Yob said. State Republicans are beginning to turn their focus to the '96 U.S. Senate race and the '96 presidential race. U.S. Rep. Dick Chrysler (R- Brighton) said the Republicans must build on their victories in the '94 elections and work toward continued success. "You ain't seen nothin' yet," Chrysler said, in reference to the up- coming elections. He added that 168 million Ameri- cans currently live in states governed by a Republican. - Daily Staff Reporter Zachary M. Raimi contributed to this report. by her son's suspension. "He's never been in any trouble in his life," she said. "(University offi- cials) were never honest or up front with me. This was like a witch hunt... Jake is a very gentle person." LSA junior Anand Shah, who took Linguistics 210 with Baker last win- ter term, said Baker was the beststu- dent in the class. "I kind of expected him not to be your average student. I think he did it more as a practical joke rather than anything serious," Shah said. "I think it was wrong that the University blew up the issue and it conflicts with the stu- dents' right of free speech." Matt Rice, a first-year RC student who lives on Baker's hall in East Quad, said he did not consider Baker a dan- ger to the students on the hall. "It seems like if he is going to be suspended there should be some kind of forseeability," Rice said. "He should know what he can and can't do." Cahill asserted that someone from within the University told the local newspaper about Baker's case. "Someone in the University has acted improperly by leaking this to the press. We're very upset about the leak because it's blown this whole thing into a national story," Cahill said. Since the first story appeared Fri- day afternoon in The Ann ArborNews, -Baker's suspension has been in De- troit newspapers and TV stations, and over The Associated Press wire, which reaches newspapers nationwide. - Daily News Editor Lisa Dines contributed to this report.
