Simpson with a methodical recounting of the physical and mental abuse it claims Simpson inflicted on his former wife Nicole Brown Simpson before he al- legedly killed her and her friend Ronald L. The first three witnesses whom prosecutor Christopher Darden put on the stand after seven months of pretrial hearings and jury selection provided the jury with details of a much-publicized incident early on the morning of Jan. 1, 1989, in which Simpson allegedly beat his then-wife. Spencer Abraham introduced a bill yesterday to cut lawyers' fees and encourage out-of-court settlements in civil cases, saying America's legal system must change to stay economi- cally competitive. "Our legal system is broken ant badly in need of repair," the Michigai Republican said. "A litigation explosion is hurting Michigan's and the nation's competi tiveness and stifling innovation witl the high costs of lawsuits and damag awards in courts - costs which ou global competitors do not have,' Abraham said. It is the first major bill Abraham ha: co-written and introduced since he be came senator, and it is the first wide- ranging bill introduced this year on legal reform. The bill is cosponsored by a longtime advocate of legal reform, Sen. Mitch McConnell (R-Ky.). "We must overcome the ob- stacles the trial lawyers have thrown in our path," McConnell said. "Le- gal reform is simply too important to leave to the lawyers and the (law- yers') bar." The bill would limit attorneys fees in civil litigation where the plaintiff seeks damages for physical or mental injury, property damage or economic loss. To encourage out-of-court settle- ments and discourage the filing if "frivolous" lawsuits, the bill would require the loser of the lawsuit to pay the winner's legal fees and allow po- tential defendants to make an early offer to pay all economic losses to avoid a lawsuit. The bill would limit punitive dam- ages againstdefen-- dants to $250,000 or three times the damages received for compensation for a loss. "It may sound anti-lawyer and Abraham maybe there's some of that here," said McConnell. "But the legal system ex- ists to compensate injured parties." The American Trial Lawyers As- sociation leadership was at meetings in Hawaii and unavailable for com- ment on the bill. The Health Care Liability Alliance said the bill might help combat a legal system that allows many meritless claims and eats up jury awards in law yers fees. "For every dollar that's spent on health care litigation, only 43 cents goes to the patient.
