"If DPS has made that kind of mistake, what other kinds of mistakes have they made?" The no-contest order would have prevented the University from holding its code hearing. In an undated letter in Welch's court file, Judicial Adviser Mary Lou Antieau asked Pollard-Hines modify her no-contact order to allow the code hearing to take place. "While the University could delay its hearing until the ninety days have elapsed, Mr. Lavie filed his complaint in April, 1994. He agreed to delay our hearing pending the outcome of the criminal proceeding. To delay further, would seem to favor the accused stu- dent at the expense of the complain- ant," Antieau wrote in the letter. But according to Lavie's written complaint, the code case was filed June 17-two months after the date Antieau mentions in the letter. On Oct. 28, Pollard-Hines modified the order to no contact "except as neces- sary for administrative hearing at U-M." Two different University reports - as well as Lavie's and Welch's accounts - have each put a different slant on the incident. According to DPS officer Michael Kelley's report, Lavie stated Welch sprayed water at his children and wife with the hose. "Lavie stated that as the neighbor began to spray his wife and his kids he approached the neighbor and grabbed the end of the hose so as to stop her from spraying his wife and kids," the report stated. Lavie also said in the report that when he tried to get the hose from Welch's hands, she kickedhim, grabbed his glasses and threw them on the ground.In thereport, Lavie further said that Welch then punched at his wife, and then scratched her. But another report, taken by Hous- ing officer Jon Lund, gave a different depiction of the incident. "Y. Lavie stated that Welch took a hose and tried to spray his wife and children with water," Lund wrote in his report. In contrast to the DPS report, Lund's report does not mention Welch spraying the Lavies during the incident. Lavie's report under the code, filed the day after the incident, also does not mention Welch spraying water. Welch maintains she did not spray the Lavies, and that she kicked Lavie in self-defense."We don't believe she tried to spray them at all," Cahill said. Lavie said he would wait until after the hearing to discuss the case. "I don't think before the hearing I want to go into public with that," Lavie said. "In principle, I think this should be held under the supervision of the University authorities." Besides charging Welch inthe June 16 incident, Lavie also has alleged earlier incidents of harassment. The alleged harassment took place over a period beginning in fall 1993, when the Lavies, who are smokers, moved into an apartment next to Welch and her daughter. Welch claims the cigarette smokefrom the Lavie's apart- ment pentrated the walls. According to Lavie's complaint under the code, Welch gave the Lavies notes to advise them to stop smoking, which Lavie refers to as "continual harassment" in his complaint. But Cahill said he will contest the admissibility of this evidence because of the six-month limit to filing code charges. "Our side is saying there isn't any evidence of harassment within the six-month period," Cahill said. Welch said Antieau initially in- cluded a statement in the charge attrib- uting the harassment to the "ethnicity" of Lavie, who is from Israel. Welch said she protested this alle- gation, and Antieau removed the charge, shredded the letter and replaced it with a document with the same date. In a Jan. 18 letter to Cahill, Antieau admitted that she shredded an original letter dated June 20. Regent Rebecca McGowan (D- Ann Arbor) said she wanfts to work to ensure the code is fair. "I would have liked to have heard from the administration about this frankly, but I have not," she said. "The code is still an interim document.
